In a new letter tonight, Alina Habba is asking Judge Lew Kaplan -- who has yet to rule on Trump's request to stay enforcement of the $83.3 million E. Jean Carroll judgment as his post-trial motions are resolved -- for some mercy. 1/
Specifically, she notes that the existing stay expires Monday and asks that if Kaplan does not rule by tomorrow, he should at least stay enforcement of the judgment for three business days after that ruling. 2/
What does this mean? Trump could be having difficulty arranging for a bond of $91-plus million, which is what will be required to cover the judgment and interest. 3/
—and expecting that Kaplan will deny his request for a longer stay, he is trying to buy himself time to obtain one or free up sufficient cash. FIN.

According to Ashleigh Merchant GA Senate testimony today, Terrence Bradley -- a lawyer she knew previously -- first approached her with his story of a relationship between Fani Willis and Nathan Wade dating back to a judicial conference. 1/
She also testified that Bradley told her to seek out Willis's "bestie," a woman he later ID'd by her photo. She is Robin Yeartie, the other witness offered by the defense to prove the origins and scope of the relationship.
And she explained that she subpoenaed travel agencies, bank records, & credit card records specifically because of what Bradley detailed to her about Willis & Wade's travel together -- including trips to Florida, Belize, a cruise, & the Bahamas.

Trump lawyer Todd Blanche released a 11-page letter to Manhattan DA Alvin Bragg tonight, accusing Bragg of "dereliction of duty" for pursuing a second plea deal with Allen Weisselberg while violent crimes in New York "skyrocket." 1/

And while Blanche is angry about Judge Juan Merchan and the DA's allegedly improper pressure on Weisselberg to plead guilty both in 2022 and today, what incenses him is that Weisselberg has been subjected to "irreparable and life-altering harm" while Michael Cohen walks free. 2/
And Blanche warns, "[I]f you choose to present testimony from Cohen in People v. Trump, that decision will have serious legal and ethical consequences for the integrity of the proceedings and for individual prosecutors who choose to suborn Cohen’s perjury." 3/

At first, I was surprised Trump was not asking for an outright stay. But then, I slowed down and read their submission and realized two things. First, they are complying with the letter of Cannon's order to submit a proposed schedule--but not its spirit. 1/
Indeed, the very first page asserts "a fair trial cannot be conducted this year in a manner consistent with the Constitution." 2/
The submission further declares a trial this year would violate DOJ policy on "actions that may have an impact on an elections" and accuses the Special Counsel of acting in cahoots with the "politically b[i]ased and calculated" "Biden Administration and Attorney General Garland." 3/

Last week, Trump asked to stay enforcement of the Carroll verdict so he can pursue post-trial motions--and avoid posting a bond. Today, he made his move in the NY attorney general's civil fraud case. 1/
In an emergency application to a NY appeals court, he vows to post a $100 million undertaking, but insists the usual 100-120 percent of the judgment is unnecessary here, both because the judgment itself is faulty & punitive and because the court-appointed monitor is in charge. 2/

There are good reasons for the Supreme Court to take a pass on Trump’s immunity argument. But one reason it might not? As promised, he’s now making the same immunity argument — albeit on even weaker factual grounds — in the Mar-a-Lago documents case. 1/

The charges in the Mar-a-Lago case that they seek to dismiss on immunity grounds concern Trump’s unlawful retention of classified materials after his presidency ended. 2/
But because that retention emanated from his lawful, official possession of the documents during his term in office, Trump’s lawyers argue that those retention charges stem from an official presidential act for which he is immune. 3/

NEW: Trump's lawyers have asked Justice Engoron for time to submit a proposed counter-judgment even though it should be a relatively plain statement of the injunctive relief Engoron ordered plus some math to fill in the pre-judgment interest.

UPDATE: Judge Engoron tells Team Trump, via email, that they need to state specific objections to the AG's proposed judgment by 5 p.m. 2/
Team Trump flags one very real issue as to to the calculation of interest for Weisselberg, identifies some address changes for the affected companies, and then complains that if Engoron won't allow for motion practice, they should get a 30-day stay of the judgment. 3/
