NEW: Five-judge panel of NY state appeals court lowers Trump’s bond required to stay enforcement of civil fraud judgment to $175 million and gives him more time to post it. 1/

Meanwhile, in a different courthouse downtown, Trump is having a much worse day in his criminal case. After reviewing Trump’s accusations of discovery misconduct by the Manhattan DA, Judge Juan Merchan notes a “pattern” that’s been “going on for months.” 2/
And that pattern, he says, is one in which he, as the presiding judge, reads or sees the same information as Team Trump but they come to a “very different interpretation.” 3/
Here, Merchan says, before taking a 45-minute-long break, the DA’s office “went so far above and beyond what they’re required to do” in terms of obtaining and producing discovery from federal prosecutors “that it’s odd that we’re even here.” 4/
As of today, Merchan had granted a 30-day adjournment starting 3/15. My guess is that he won’t rescind that per se, but in exchange for extra time for trial prep, Todd Blanche took a meaningful credibility hit with the judge before jury selection has even started. 5/
Why do I say that? In the process of an extended question and answer with both sides, Merchan forced Blanche to admit that the Manhattan DA’s office does not control DOJ prosecutors or the FBI, as would be necessary to impose extra discovery burdens on them under NY law. 6/
He further got Blanche to concede that it’s not Trump’s position that the DOJ purposefully withheld documents from Trump or the DA’s office. 7/
And finally, he got Blanche to tell the world what many already knew: He spent 4 years as a paralegal and then 9 years as a prosecutor at SDNY. 8/
And therefore, Merchan suggested, Blanche knows well that he could have complained about the DA’s discovery or requested it himself from SDNY well before two months ago. Stay tuned for a potential ruling and/or trial date after the break. FIN.

Put aside Alito, who’s comfortable second-guessing the FDA’s weighing of scientific data. The rest of the justices weren’t all that interested in questioning the FDA’s judgment, despite a majority hostile to both regulatory deference and abortion access. What gives? 1/
If I had to guess, it’s the FDA that’s making the difference. In general, industries don’t love the agencies that regulate them. But the relationship between the pharmaceutical world and the FDA is far more symbiotic. 2/
Here, a handful of amicus briefs warned that reversing FDA decisions over drug safety and efficacy would discourage investment in drug research and development, and ultimately, cost American lives. 3/

Yesterday’s hearing in the Trump hush money case was overshadowed by the news that Trump only has to post a $175 million bond. But it was riveting and important. 1/
Trump’s most frequent refrain about that indictment is that it’s just another example of Biden election interference. But presented with extensive histories of communications between the U.S. Attorney’s Office and the DA’s office, Judge Juan Merchan found the opposite. 2/
Specifically, he said: “The exhibits and the evidence that I reviewed are clear that the U.S. Attorney’s Office and the District Attorney’s Office never, during the course of their respective investigations, collaborated in any way, shape, or form on either investigation.” 3/

NEW: Earlier today, Trump said two seemingly unrelated things about his money that strike me as entirely intertwined. First, he said his collateral for the now-$175 million bond would be cash. 1/
And then, he said he "might spend a lot of money on my campaign," adding that "[t]hey" -- presumably referring to Judge Arthur Engoron and/or New York attorney general Letitia James -- "don't want me taking cash out." 2/
How are these developments related? Well, start from the @nytimes reporting on that securing even this substantially reduced bond will "effectively drain much of his cash." 3/

NEW: The Manhattan DA has shared its filings opposing Trump’s bid to dismiss its indictment or obtain a 90-day adjournment of trial because the DA allegedly withheld documents relating to Cohen’s SDNY convictions. But as the DA said, it never had several of Cohen’s statements. 1/
And in particular, the DA reveals that SDNY did not itself come into possession of five of Cohen’s statements to the Special Counsel investigating Russian interference — aka the Mueller investigation — until December 2023. 2/ Image

As @KatiePhang noted yesterday, prior mortgages on Trump properties won’t prevent Tish James from trying to collect on them. But some of those loans are bigger than appreciated. Take Axos Bank’s loans to Trump for Trump Tower’s commercial portion and the Doral course. 1/
Both loans are listed as “over $50 million” on Trump’s August 2023 Office of Government Ethics disclosure. But, according to @washingtonpost, those loans are for $100 million and $125 million respectively. 2/
