1. A new lawsuit against a gender affirming care ban in Ohio has a novel approach to overturning the ban: a Republican anti-Obamacare amendment from 2011 banning government interference in the purchase or sale of healthcare.

2. The new lawsuit, filed by the ACLU, asserts that the trans ban in the state is unconstitutional.
It alleges that the law violates single-subject rules, equal protection, due process, and... an anti-Obamacare amendment from 2011.
3. This novel strategy comes after mixed results in federal courts. For instance, the 8th and 9th Circuit Courts have blocked gender affirming care bans from going into effect, whereas the 6th, 7th, and 11th have allowed them.
4. The provision in question that may result in the new law being blocked is a constitutional amendment in 2011 that says "No federal, state, or local law or rule shall impose a penalty or fine for the sale or purchase of health care or health insurance."
5. This latest lawsuit, if successful, could protect trans Ohio healthcare regardless of what the Supreme Court decides. Given Ohio's protections, they may be afforded even more security than those given by the US constitution on this issue.
6. This is not the first time a Republican law may foil an anti-trans policy. In Montana, the gender affirming care ban was blocked due to a Republican law guaranteeing a "right to try" non-approved medication, passed to protect Ivermectin for COVID.
7. The law is set to go into effect on April 24th this year. Attorneys are asking for a temporary restraining order and/or a preliminary injunction barring the AG from enforcing the law as well as the state medical board.

Libs of TikTok, Riley Gaines, and other huge anti-trans far-right activists are trying to flood Maine legislators so that they don't pass a sanctuary bill for transgender people.
