BREAKING: Judge Juan Merchan enters an Order on the Manhattan DA's Motion for Clarification wherein he orders the following amendments to that original 3/26/24 gag order:
Trump's "pattern of attacking family members of presiding jurists and attorneys assigned to his cases serves no legitimate purpose."
"It merely injects fear in those assigned or called to participate in the proceedings, that not only they, but their family members as well, are 'fair game' for Defendant's vitriol."
"It is no longer just a mere possibility or a reasonable likelihood that there exists a threat to the integrity of the judicial proceedings. The threat is very real."
"The average observer, must now, after hearing Defendant's recent attacks, draw the conclusion that if they become involved in these proceedings, even tangentially, they should worry not only for themselves, but for their loved ones as well."
Here, Judge Merchan makes short shrift of Trump's arguments in his opposition filing:
Judge Merchan also puts Trump on notice that he will forfeit his right to access to jurors' names "if he engages in any conduct that threatens the safety and integrity of the jury or the jury selection process."
Judge Merchan rules that Trump is "hereby warned that any violation of this Order will result in sanctions under Judiciary Law, Sections 750(A)(3) and 751."
750(A)(3): criminal contempt can be willful disobedience of a court order.
751: punishment for contempt: a fine "not exceeding $1000, or by imprisonment, not exceeding 30 days, in the jail of the county where the court is sitting, or both, in the discretion of the court."

In response to Trump’s pre-motion letter to be able to file a renewed motion to recuse Judge Merchan, the Manhattan DA’s Office submits its opposition letter:
The People argue that Trump has already argued - and LOST on the claim that Judge Merchan's daughter's company marketing to Trump's political opponents is enough to recuse.
In fact, the Advisory Committee on Ethics has already deemed this not to be a basis for recusal.
The People cite to this language in an opinion by the Ethics Advisory Committee: "A relative's independent political activities do not provide a reasonable basis to question the judge's impartiality."
JUST IN: Donald Trump has filed a pre-motion letter to recuse Judge Juan Merchan. This is another attempt by Trump to get Merchan off of his case.
Trump alleges that b/c Judge Merchan's daughter works at a company that makes money based on supporting Democratic causes & candidates, and b/c his daughter's company "has used this case to money", the Judge must recuse himself.
Then, Trump claims that b/c the Court has entered a gag order that prevents him from protected campaign speech & b/c the Court has made extrajudicial comments about the case, the judge must recuse himself.
However, the Fla. Supreme Court upheld the state's current 15-week abortion ban, which now paves the way for a 6-week abortion ban to go into effect in 30 days that includes exceptions for rape, incest or human trafficking, but only through the first 15 weeks of pregnancy.

JUST IN: The Manhattan DA’s Office files this pre-motion letter with Judge Juan Merchan seeking clarity that his gag order entered on March 26th against Donald Trump “protects family members of the Court, the District Attorney, & all other individuals mentioned in the Order.”
The DA’s Office cites in Footnote 1 Trump’s recent Truth Social posts that baselessly attack a family member of the Court. DA Bragg also seeks to have the Court warn Trump that his “recent conduct is contumacious” and if he continues, he will be in direct violation of the Order.
Trump responds to the Court advising that the gag order doesn’t require any clarity and that it DOES NOT include family members of the Court.
It also claims that Trump’s Truth Social attacks on Judge Merchan’s daughter are appropriate because it’s “protected campaign speech.”

Background: Trump is in court in NY before Judge Juan Merchan trying to get his case either dismissed or continued further because of his claims of prosecutorial misconduct in not turning over discovery.
Judge Merchan is visibly ANGRY. He is demanding Todd Blanche, Trump's lawyer, explain why they waited until just two months prior to trial to obtain the discovery documents that he's complaining about today.
Merchan to Blanche: "You are literally accusing the Manhattan DA's Office and the people assigned to this case of prosecutorial misconduct...and you don't have a single [case] citation to support that allegation that the USAO is under the DA's control."
