Hi all. Nerdy policy wonk who follows Congress closely weighing in with a thread on legislation (getting no media coverage) moving rapidly through Congress that targets US non-profit orgs, with the immediate & explicit target being orgs involved in Palestine protesting.

I'm talking here about a bipartisan legislation the House passed last week (382-11) & that was intro'd last week in the Senate -- HR 6408 & S. 1436.

This will gives a single US official authority to strip US non-profits orgs of their non-profit status in a peremptory manner, w/ virtually no limitations, accountability, or meaningful recourse, based merely on his declaration they are “terrorist supporting organizations”

The explicit target of this legislation is orgs involved in/supporting protest against Israel’s war on Gaza, most notably SJP. But of course, if passed into law, it could be used against any tax-exempt org working for an objective disfavored by the Admin in power.

The intent behind the bill — the targeting of groups engaged in protest for Palestinian rights/lives — has been made explicit - e.g., here's the Chair of the House Ways & Means Committee when it was marking up/passing the bill last November:

Reminder: US charitable organizations — like ALL US entities — are already barred, by law, from providing material support for terror & already face intense scrutiny.

The goal of the new legislation is to dispense with the due process (incl the need for evidence) afforded under law to targeted groups, empowering a single US official to act as prosecutor, judge, jury, & executioner of US orgs whose viewpoints that official disagrees with.

Those whose prioritize shutting down pro-Palestine protest above all else may view this legislation as excellent news.

Those concerned with Palestinian rights/lives, and those who view with concern the rapid erosion of free speech/protest rights in the US, may disagree.

Either way, it is remarkable that this legislation--which has profound implications for protest/free speech in the US-- is so far going pretty much unnoticed.

I’m getting lots of journalists asking me about this story and this quote:

“The Biden administration made clear to the Palestinians that current U.S. law compels the administration to veto such a resolution or defund the UN, a U.S. official said."

Here are the facts:
1/
Fact 2: There is no US law compelling the Admin to veto such a resolution.

2/
Fact 2: there are two pieces of law that would, indeed require the US to de-fund the UN if this resolution were to pass.

Rosen (D-NV) et al have intro'd new far-reaching legislation on antisemitism...at the center of which is of course the IHRA definition & the conflation of antisemitism w/ criticism of Israel &/or Zionism. A quick breakdown of IHRA-related elements in this bipartisan bill.

1/
(A) It includes an overarching Sense of Congress that the IHRA definition "should be utilized by Federal, State, and 20 local agencies" -- in direct contradiction to Biden Admin's non-centering/endorsing of the IHRA definition of antisemitism as part of its antisemitism strategy
(B) It includes an overarching statement defining antisemitism according to the definition included "in section 3 of the 25 Never Again Education Act (36 U.S.C. 2301 note)" -- which is, in fact, the IHRA definition w/o attribution to IHRA or listing its examples.

DOD funding/programs: The bill provides $10.6 billion in Department of Defense funding for Israel, of which $801.400 million is for ammunition; $5.2 billion is for Iron Dome, David’s Sling, and Iron Beam; and the balance is included in various Israel/Ukraine joint line items

SFOPS funding/programs: The bill provides $3.5 billion in Foreign Military Financing (cash) for Israel to buy weapons/military supplies, of which Israel can spend $769.3 million in Israel, & has further authorization to spend the rest in Israel, “if agreed"...
