A new defense motion in FLA documents case accuses Jack Smith of continuing to slow walk handing over evidence.

This relates to a disclosure in bombshell Jan motion that outlined collusion btw NARA, Biden WH, DOJ, and other agencies to manufacture some sort of documents crime against Donald Trump right after he left office.

Part of the motion revealed that Dept of Energy (run by former MI Dem gov Jennifer Granholm) discovered AFTER Smith filed his June 2023 indictment that Trump still maintained a “Q” (not that Q) security clearance.

DOE then retroactively terminated Trump’s security clearance.

Trump’s lawyers asked—and Cannon ordered—the production of some records related to how the termination of the clearance came about. Smith, of course, is attempting to conceal the paper trail.

And it appears the special counsel is referring to the post-indictment
discovery and termination of Trump’s clearance as an “after action” report.

I can only imagine how Judge Cannon reacted to that (appears that description was discussed in sealed motion and/or hearing)Image
The last paragraph seems to suggest the defense will ask Cannon to order the special counsel to produce similar records from other departments.

For example—did DOJ or Biden WH ask every fed agency including DOD to search for security clearances for Trump and if any such clearances existed to retroactively terminate those as well?

Judge Cannon took quite a bit of time during an April hearing to walk through how security clearances worked. She wanted special counsel on the record to explain the government’s position on the conferral and termination of a clearance.

Jay Bratt claimed a clearance automatically ends once an individual leaves office or his position.

Of course that’s not true (I believe in one motion disputing that claim, Trump raised John Brennan’s clearance, which he terminated.)

If Trump still held official clearances at the time of the indictment, it blows a huge hole in the “willful” and “unauthorized” elements of the Espionage Act charges.

Merrick Garland will testify before @JudiciaryGOP this morning. (Let's hope Republicans do a better job than they did yesterday with Fauci.)

Garland reportedly will denounce "baseless" attacks against DOJ including use of deadly force policy in FBI plan to raid MAL.

Garland claims the language is "standard" and was contained in the FBI plan to search Biden's home for classified documents.

OK - bring the receipts, Mr. AG. Where is the FD-888 or any other document to prove his claim re: Biden?

It's sort of interesting that Special Counsel Jack Smith TWICE failed to note the use of deadly force language in Biden search documents in his gag order request related to that very issue.

Are you aware that Smith's lead prosecutor Jay Bratt misled Judge Cannon--something Smith admitted in a brief last month--about the condition of evidence seized at Mar-a-Lago?

What is the status of the DOJ OPR investigation into Bratt for threatening a defense attorney?

The presiding judge in this case was Judge Amit Mehta, an Obama appointee and one of the toughest on J6ers. It was one of the first J6 trials.

Jury selected in one day.

He was convicted in a matter of hours. Image
Webster is a former Marine and once worked security detail at Gracie Mansion.

He approached the police line after he witnessed police officer assaulting protesters including a woman.

Mehta refused to let the jury see several minutes of video before Webster confronted police.

This is unbelievable. Appellate panel ENDORSED a sentencing enhancement bc Webster wore "body armor" to protect himself.

I can tell you as someone who has covered these proceedings diligently including attending court hearings, Cannon will not take lightly Smith's failure to confer with defense in any meaningful way before posting the motion.

My followers already know this because after Smith filed his motion, I noted how many times Judge Cannon has scolded prosecutors for making vague claims about witness safety in their requests to seal evidence.

Which is why my first reaction to Smith's motion is that DOJ just opened a can of worms.

Within the span of a half hour last week, one of Jack Smith's prosecutors in classified docs case called defense argument "garbage," told Judge Cannon the proceeding "is no way to run a railroad," and pounded on podium, clapped his hands in rage:

David Harbach threw a mini temper tantrum over claims that Jay Bratt, Harbach's co-counsel on Smith's team, threatened a defense attorney during an August 2022 meeting.

Stanley Woodward, who represents Walt Nauta, Trump's valet also charged in the case, has alleged that Bratt wanted Nauta to flip on Trump and become a government witness.

During the August 2022 meeting, Bratt--according to a court filing by Woodward--brought up Woodward's pending judicial application before DC Superior Court. Bratt said something like, "you don't want to do anything to mess that up." Meaning--get your client to cooperate.

The meeting is a subject of a congressional inquiry, a DOJ Office of Professional Responsibility probe, and Nauta's motion to dismiss for vindictive prosecution.

Cannon is considering the motion and Nauta's request for any discovery related to the meeting including correspondence.

This is how one exchange went down Wednesday morning as Cannon pressed for details about Harbach's knowledge of records about the meeting--Harbach had just described Woodward's account of the August 2022 meeting a "fantasy."Image
Bratt also allegedly said to Woodward something about "we don't view you as a Trump lawyer."
