In case you have heard that @X has closed its office in Brazil, that Brazilian Supreme Court (@STF_oficial) ordered to imprison one of Twitter's executives and you are wondering what is going on in Brazil, here is a brief 🧶
Spoiler: it is likely @X will be blocked soon in Brazil
Twitter’s @GlobalAffairs team published the court order they have received – and decided to ignore – which was issued by the Supreme Federal Court (STF) requesting to block accounts engaging in multiple illegal behaviours (fake news, hate speech, etc)
@GlobalAffairs Twitter explicitly evaded the subpoenas issued by @STF_oficial and decided to close its office in Brazil, to “protect employees”.
With no 🇧🇷 office, no one can be held liable for failure to comply with subpoenas, as they explicitly point out in this post
The court order is deemed unjust by @X. However, it is a court order...
Hence, it is likely – or sure - that over the next weeks - or days - Twitter will be blocked in Brazil.
Blocking an app is considered proportionate when a provider ignores court orders or refuses to comply.
@X Twitter is betting that users will be furious and will put political pressure on the Supreme Court, evoking censorship and authoritarianism. This is probably true, although it is highly unlikely that twitter users’ protest will be heard if @X will be blocked…
FIN
By exiting Brazil, it is unlikely that @X can be forced to comply with Brazilian court orders - which will be abundant in the coming months of municipal election campaigns in Brazil - because compliance will need to rely on lethargic/ineffective Legal Assistance Mechanisms.
