Recently unsealed evidence shows that the DOJ and FBI had evidence of my husband’s (@eithanhaim) innocence 10 months before they indicted him, but they ignored it and did it anyway. 🧵

As reported by Fox News today (@kendall_tietz), the court unsealed two key pieces of evidence that were previously attached to a defense motion. This is the first time the public can see some of the documents that upend the DOJ’s entire theory of the case.

For context, when Eithan was indicted back in June, the DOJ’s case was that he was officially assigned to another hospital at the time, and allegedly had “no reason” to be accessing Texas Children’s Hospital (TCH) medical records. The evidence shows they were so wrong that I honestly can’t explain it other than monumental incompetence (or, of course, bad faith).

(1) On August 30, 2023, TCH, through its counsel BakerHostetler, wrote a letter to HHS regarding its investigation of the alleged HIPAA breach at TCH. In it, they state unequivocally, Eithan “had approved and authorized access to TCH’s [electronic medical records]” and “TCH’s policies and procedures were followed” when he was granted access by the hospital. They also showed that he was providing coverage for patients at TCH during the relevant time period.

(2) The DOJ’s indictment apparently relied on testimony from a plastic surgeon, Dr. Larry Hollier, that Eithan had “no documented reason to access the TCH system.” Hollier never met Eithan, wasn’t even in the same specialty, and his statements were obviously contradicted by TCH’s letter. Btw, this guy also happens to sit on the board of TCH.

After being forced to acknowledge that Eithan was actually treating patients at TCH, the DOJ basically conceded that they presented false information to the grand jury. Oops! But they want us (and the court) to believe that it’s all totally fine because they say they didn’t do so “knowingly.”

One would think that presenting false information to a grand jury, whether knowingly or unknowingly, would force the DOJ to scrap this case like the garbage it is. Especially when that information is central to their theory of the case.

But no! They’re doubling down. They have gotten two more indictments since then on increasingly insane legal theories. And just as this was being exposed, they moved to gag Eithan from talking about it. That’s why I’m speaking out. See below for details (1/5).

(4/5) They admitted that their indictment was based on the testimony of Dr. Larry Hollier, a plastic surgeon (different specialty) who never even met Eithan. He said Eithan had no “documented reason” to be accessing the records at TCH…but again, TCH said something different to HHS. Obviously his testimony was factually incorrect, and DOJ ignored the contradicting evidence.

And the three people at Hollier’s interview were the same people who knew (or should have known) of TCH’s HHS letter for 10 months: Tina Ansari (former DOJ lead prosecutor), Paul Nixon (FBI agent), and TCH’s counsel (BakerHostetler).
(5/5) As Eithan’s counsel wrote in his opposition brief to the gag order, “the original indictment was founded on lies that in other situations would be actionable slander.” And those lies continue to plague the case today, as the minimal Second Superseding Indictment still contains the allegation that Eithan accessed information under “false pretenses.”

There's the famous quote from Stalin's head of secret police: “show me the man, I’ll show you the crime.” That’s what this case has been from the beginning. The DOJ and FBI had information in their possession that disproved their entire case all along, but ignored it in order to send a man to prison for 10 years.
The only reason we can expose the corruption in this case is through the hard work of Eithan's counsel. Every win costs tens or even hundreds of thousands. Please consider making a donation (or just sending prayers) to Eithan's legal defense fund!

2/4 Yesterday, the Subcommittee on the Constitution on Limited Government wrote a letter to Texas Children's Hospital, demanding that it produce to Congress all docs regarding:

- its decision to "restart" transgender interventions on children after publicly stating they stopped

-the lecture from January 2023 where they admitted (internally) that they still had a transgender program

-whether they are still doing it today

-how they identified Eithan as the whistleblower

-and, importantly, its communications with the US Attorney's Office regarding Eithan, including the former lead prosecutor, Tina Ansari.Image

3/4 Representatives Jordan and Roy state unequivocally "the DOJ’s prosecution of Dr. Haim for blowing the whistle on criminal child abuse is wrong."

This begs the question, when the chairmen of the House Judiciary Committee and Subcommittee on the Constitution and Limited Government call your prosecution flat-out "wrong" - how in the world can the DOJ continue to bring this case?

My husband’s (@EithanHaim) First Amendment rights may be under attack by a de facto gag order – but mine are not. 🧵1/7

On Dec 3, the judge threatened Eithan with FEDERAL PRISON and his attorneys with sanctions if they continue to post so-called “inflammatory” content on X about the DOJ’s corruption in this case.

He didn’t grant or deny the gag order, but kept the government’s motion “live” pending trial in February. This is arguably worse and serves two purposes.

(1) The court’s instruction to avoid “similar conduct” leaves unclear what kind of speech represents a violation (presumably that which the DOJ doesn’t like? see below) and what the consequences would be – imposition of a gag order merely being one of them.

(2) By leaving the matter undecided, the court is shielded from public criticism and appellate review (where it would likely be overturned as unconstitutional in the Fifth Circuit).

As a result of this “non-gag gag order,” the onus is on the defense to muzzle themselves. It’s an unconstitutional prior restraint of someone who needs free speech the most: the criminal defendant David facing a corrupt government Goliath.

I was not planning on speaking publicly about this case. I’m a private person, and I don’t really use social media. But Eithan’s X posts have been the only way he has been able to raise funds for a legal defense and expose the DOJ’s blatant corruption over the last year and a half.

As a wife and attorney, I can’t sit by while they extinguish the light he’s shone on this case, particularly as newly unsealed evidence proves that this case was malicious all along (more on that later!).Image
2/7 As background, Eithan is the whistleblower who exposed in a report with @realchrisrufo that Texas Children’s Hospital was lying to the public about the existence of its transgender program for children. They were implanting puberty blockers on kids as young as 11 and hiding it from the public.

He is currently facing 4 felony charges on a made-up, baseless HIPAA theory. The DOJ’s case is falling apart for both legal and non-legal reasons (see @EdWhelanEPPC’s and @AndrewCMcCarthy’s excellent reporting on this in the National Review).

Everyone should read this recent article from Tom Bartlett at the Free Press (@TheFP). His thorough reporting really captures what this case is about and what it has been like to live with it.

3/7 Since January 2024, Eithan has been vocal on X about the corruption we've experienced since the government first showed up to our home in June 2023.

Most recently, he’s been posting about the prosecutors’ failures using screenshots of public motions and transcripts, including a motion to dismiss hearing where they really embarrassed themselves.

He also posted about serious financial and personal conflicts held by the former lead prosecutor, Tina Ansari (link below). Great reporting from @kendall_tietz.
