NEW: As part of my effort to track @ElonMusk's influence in the Texas Capitol, I asked for all of his emails with Gov. Greg Abbott for the last several months.
Abbott's office rejected my request, saying some of the records are too "intimate and embarrassing" to release. #txlege
Specifically, the governor's lawyer argues that Abbott and Musk's emails are "intimate and embarrassing and not of legitimate concern to the public, including financial decisions that do not relate to transactions between an individual and a governmental body." [my emphasis]
#txlege #ElonMusk
Abbott's lawyer also had other reasons for why the governor's emails with #ElonMusk should not be released. He said they include:
- private exchanges with lawyers
- details about policy-making decisions
- and information that would reveal how the state entices companies to invest here. #txlege
I file a lot of records requests. This time, I encountered something unusual.
Abbott's office charged me $244 to search for his comms with #ElonMusk. They said it would take 13 hours of staff time.
But after the check was cashed, Abbott's office told me they determined all if the records were private. #txlege
Abbott's office could have redacted his emails with #ElonMusk. They could have released some and withheld others.
Instead, they said none of them could be released.
Ken Paxton's office, which referees public records disputes, will decide whether I get the records. #txlege
A lawyer for @SpaceX also doesn't want the emails with Gov. Abbott released. He cited just one main reason: They contain “commercial information whose disclosure would cause SpaceX substantial competitive harm.”
NEW: Texas AG Ken Paxton and his blind trust own 10 properties in five states. This includes a luxury cabin for rent at $525/night, three homes in Florida and land in Hawaii.
But Paxton's disclosed just one to ethics regulators. Why the secrecy? #txlegekut.org/2024-09-18/tex…
Last year, we reported Paxton was not disclosing all of his real estate holdings. He said he wasn't breaking the law but experts question that.
This year, Paxton is disclosing even less. Three homes he and his wife own are absent from state forms. #txlegekut.org/politics/2023-…
For months, we've tried to get the attorney general to answer questions about why he's choosing not to disclose these properties to the state.
At first, silence. Then we intercepted him at an event. He called our reporting a "made up issue."
#txlege
State budget writers recently earmarked money for A/C for the first time. The agency head hopes to get more money next year — but could not guarantee it.
Prison officials also testified that they have to deal with the issues posed by a massive and aging system. #txlege
The plaintiffs argued the lack of A/C in state prisons amounts to cruel and unusual punishment.
They do not trust that the state is dedicated to quickly fixing the problem, and they want the federal judge to order the agency to act. #txlegekut.org/crime-justice/…
NEW: For the last few months, I've been looking through thousands of pages of Texas AG Ken Paxton impeachment documents not released during trial.
Among them I found sealed records from the federal grand jury investigation into Paxton.
#txlegekut.org/2024-05-23/don…
The docs, which prosecutors said were turned over by the AG's Office, show the scope of the probe in 2021.
The feds at that time were looking into “several potential federal crimes" incl. obstruction of justice, retaliation against witnesses, bribery, wire fraud and conspiracy.
The Texas Senate, as the court of impeachment, allowed me to view the records in person and make copies of the docs I wanted, including those from the sealed grand jury case.
For transparency, I have republished the document unchanged here. #txlegekut.org/2024-05-23/don…
Time remaining in the impeachment trial is 14 hour 28 mins for each side.
That means we may be done with this by Thursday, @DanPatrick notes. The jury "may have this in your hands late Thursday or early Friday."
Patrick says no days off until a decision. #txlege #PaxtonTrial
@DanPatrick Prosecution calls Mark Penley. He was the deputy AG for criminal prosecution in 2019-2020, and a former federal prosecutor for 16 years before that.
He was among those who sued the agency. He was fired after reporting Paxton to the FBI in 2020. #txleeg #PaxtonTrial
BTW here is the discussion between Nate Paul and this witness (Maxwell) in which Paul's lawyer says they think the FBI came searching for "drugs and money and drugs" and then altered the search warrants when they found none.
