Today I have signed the Liberty and Opportunity Act of 2052 as Governor of North Dakota. Here is what we will deliver for you the people 🧵
Universal Education Freedom:

LOA2052 establishes Education Savings Accounts (ESAs), funded at the full foundation aid amount per K–12 student (~$10,000/year).
ESA funds may be spent on private school tuition, tutoring, online education, homeschool materials, and special education services.

LOA2052 repeals open enrollment restrictions and mandates statewide interdistrict enrollment.
LOA2052 will also establish a state-level Charter School Authorizing Board with the power to approve new charters independently of local school boards.
Zoning and Land Use Reform:

Municipal bans on duplex, triplex, and quadplex residential buildings in cities of population ≥10,000 will now be preempted and repealed under state law.

Minimum lot size requirements over 5,000 sq ft in urban zones are hereby repealed.
Off-street parking minimums for residential development are now banned within the state.

LOA2052 will mandate "by-right" housing approvals within 60 days if developments comply with base zoning.
Extraterritorial zoning authorities in counties under 10,000 residents will be abolished.
Prohibition of Assisted Suicide:

Physician-assisted suicide is now criminalized within the state of North Dakota.

LOA2052 will define the act as prescribing or providing substances with intent to facilitate self-inflicted death.
Violations are classified as a Class C felony (up to 5 years imprisonment and/or $10k fine) and mandates professional license revocation.
Privatization of Correctional Operations:

LOA2052 will permit private corrections firms to operate ND correctional facilities via competitive contracts.
Contracts must include performance metrics, ACA accreditation, and recidivism-reduction incentives.
The State retains responsibility for parole, probation, and independent oversight.
Occupational Licensing Reform:

LOA2052 enacts universal recognition statute (§43-51-01) for licenses held for ≥1 year in another U.S. jurisdiction.
Under LOA2052, licensing requirements for low-risk professions (e.g., interior designers, auctioneers, shampoo technicians) will be repealed.

LOA2052 will establish temporary licensure for military spouses and new residents.
NDOMB will issue mandatory annual licensing transparency reports.
Healthcare and Telehealth Access:

Under LOA2052, Out-of-state licensed physicians will be permitted to provide telehealth care to ND patients.

E-prescribing for Schedule III–V substances is now legal.
LOA 2052 will now require reimbursement parity for telehealth from all health plans and Medicaid MCOs.
Transportation Deregulation:

LOA2052 will preempt local ordinances that ban or regulate transportation network companies (TNCs) state-wide.

Medallion-based taxi restrictions will also be preempted under LOA2052.
Intercity bus and freight services will be deregulated within state jurisdiction.

LOA2052 will also legalize micromobility statewide.
Rural and Homesteading:

LOA2052 permits homesteading of designated underutilized state-owned land parcels in counties with <15 persons per sq mi
Claimants will be allowed to receive freehold title after 3 years of continuous residence and improvement.

LOA2052 also establishes formal title pathways for residents of informal housing (e.g., mobile homes without recorded leases or platting)
Community land trusts and co-housing models statewide are now legal statewide.
Ukrainian Refugee Resettlement and Integration Incentives:

Eligible individuals must be of Ukrainian nationality and hold legal refugee or parolee status under federal law AND declare intent to reside in North Dakota for ≥2 years.
New provisions will be established to —

Streamline occupational licensing recognition for Ukrainians holding valid foreign certifications in designated high-need professions.

Minor children of Ukrainian refugees will also be immediately eligible for ESAs under LOA2052.
Eligible persons may participate in state-sponsored homesteading programs under LOA2052.

Eligible Ukrainian refugees establishing new enterprises in the state can qualify for fee waivers for business registration and LLC formation.
The Office of Refugee Coordination will be directed to coordinate with the ND Association of Counties and certified resettlement agencies to ensure housing, employment, and education integration for eligible persons.
