On the last hearing the Court had pulled up the State government for naming more than 2000 individuals as accused remarking that a “cricket stadium” would be required to conduct trial.
Sr. Adv. Kapil Sibal (for Balaji): these are 3 applications.
Justice Kant: after 2 years you’re filing applications.
Sibal: without notice they have filed counters in 25.2. All that I want is in the first application the matter may be decided by the trial court without being influenced by the observations. I want a caveat. That’s all I want.
Justice Kant: where were the observations made?
Sibal: the observations were made in Senthil Balaji vs. Y Balaji.
Order: we have heard Ld. Sr. Counsel. various prayers have been made in these Misc. applications. Mr. Sibal restricts his prayer only to clarify that the observations made in the judgements shall have no bearing in the pending trials. The MAs are disposed off with the clarification that the observations shall have no bearing on the pending trials.
Court now hears the case of Y Balaji(one of the victims in the cash for jobs scam):
Sr. Adv. Gopal Sankarnarayanan: this is the case where the appointment of a special prosecutor is pending. We had suggested a list of names. The SLP is item 26. And the MA is item 37. MA deals with the appointment of SPP. 26 is the SLP where there were thousands of accused. Your lordships had asked for a chart. It’s where the HC had said they will not interfere in the order of clubbing. They’ve given the names. We’ve updated our list based on that. There’s a list of main accused in CC No. 24. The main accused are the erstwhile transport minister, his brother and their confidants. There are total 2202 accused.
