The new filing, Thomas v. Monarez, was made on August 15, by the same lawyer who recently pushed (successfully) for CDC to remove the Covid-19 shot from the childhood schedule, Rick Jaffe.
Now, he set his sights even higher: on the childhood vaccine schedule itself.

The complaint begins with a blunt reminder:
The U.S. runs “the most aggressive vaccination program in the world,” requiring 72 doses by adolescence.
And yet the combined, long-term safety of this schedule has NEVER been studied.

It also claims vindication for every doctor who has been canceled and had their medical license revoked.
Just listen to what happened to Plaintiffs Dr. Paul Thomas and Dr. Kenneth Stollar:
“When Plaintiff Dr. Paul Thomas published a study finding vaccinated children had significantly higher rates of chronic illness, which is exactly the research IOM recommended, his license was suspended within five days… [and] suffered concrete injury when his medical license was suspended and his 14-year practice destroyed.
This occurred after he published peer-reviewed research comparing health outcomes between vaccinated and unvaccinated children, the very type of study the Institute of Medicine had urged CDC to conduct.
When Plaintiff Dr. Kenneth Stoller used genetic markers to identify at-risk children, California's Medical Board declared only CDC guidelines could be followed, and revoked his medical license.
The message is clear: conform or face professional banishment.”

Sadly, the only protection children have are parents and doctors who are brave enough to stand between them and medical mandates.

The lawsuit goes on to highlight a shocking fact about exemptions:
“A child who suffers seizures, developmental regression, or autoimmune disease after vaccination typically will not qualify for exemption unless the reaction was immediate anaphylaxis or the exact same reaction occurs with subsequent doses.”
In other words: one devastating injury isn’t enough. Parents are forced to roll the dice again.

The suit challenges the CDC on multiple constitutional and administrative grounds. According to counsel:
First, the agency violated the Administrative Procedure Act by issuing de facto mandates without rule-making and ignoring cumulative safety.
Second, it violated the Constitution by creating untested federal standards that states enforce as mandates, stripping parents of informed consent, denying medically vulnerable children recognition, and suppressing dissenting physicians through coordinated professional retaliation.
If the CDC childhood recommendation foundation fails, the mandates built on top of it must be reconsidered.
