Scott Schara (@GraceEmilysDad), Grace’s father, introduced us to Grace’s story:

“So I'm going to tell you a little bit about her. Grace had Down syndrome. She was only 19, and we took her to the hospital in October 2021 because her oxygen saturation had dropped to 88%. We were under the illusion that this was an emergency. We chose to admit her under the premise that I could stay with her, and that they would put her on supplemental oxygen and a steroid for three or four days as a precautionary measure, and then we’d take her home. And if they had only done that, Grace would be alive today.”

Schara v. Ascension Health was the first COVID-era hospital negligence case in America to reach a jury trial. This landmark lawsuit, which concluded on June 19, 2025, lasted three weeks and was passionately argued by a dedicated legal team led by attorney Warner Mendenhall (@MendenhallFirm) and @Freedom_Counsel.

Warner Mendenhall shared, “I really thought we had created enough space in our society—with all the medical revelations, all of Scott's efforts to publicize, and the good team and resources we had—to win this case. I thought we had a real shot at it. And I will tell you honestly, I've never had a judge give us as much time to make our arguments as this judge did. His willingness to allow us to fight, to keep the rules fair, and his knowledge of the case were exceptional.

It was truly one of the most remarkable trials of my life. I just have to say that, although we lost, it was a remarkable honor to participate on behalf of the Schara family.”

First takeaway: Know the definitions and implications of DNI (Do Not Intubate) and DNR (Do Not Resuscitate)

IMA co-founders Dr. @joevaron and @drpaulmarik1 join the discussion, as Scott Schara continues, “On October 8, Dr. M. came into the room and said, ‘You're going to need to put your daughter on a ventilator in the next two hours.’ Grace was fine, but I asked him, ‘What is the prognosis if someone goes on a ventilator?’ He told me a version of the truth, which is that only 20% of people walk out alive. That was a wake-up call. I started researching ventilators immediately. After that, there was subtle pressure to give pre-authorization. We were asked four different times. It was framed as, ‘These types of things tend to happen in the middle of the night when we can't reach the family.’ We weren’t going to give any pre-authorization for a ventilator!

In the depositions, we learned that staff internally interpret ‘DNI’ as ‘DNR’ (Do Not Resuscitate). And the doctor, in fact, put a Do Not Resuscitate order on Grace’s chart at 10:56 in the morning on October 13.”

Good news! Yesterday, the Fifth Circuit Court of Appeals reversed court’s ruling that “sovereign immunity” protects FDA from any wrongdoing or harm in telling the public to stop taking ivermectin, a safe, well-studied, and proven drug for the prevention and treatment of COVID-19. Image
2) The lawsuit was first filed by Drs. @RobertApter1, Mary Talley Bowden @MdBreathe and our own @drpaulmarik1 in June, 2022, and stated the FDA was acting outside of its authority and illegally interfering with doctors’ ability to practice medicine. The case was later dismissed.
3) Earlier this year, Apter et al filed an appeal, requesting the Court to reverse the dismissal. The reversal was issued yesterday, and the ruling said, in part:
