Tea leaf update re the #VaRedistricting case(s):
1. No opinion yet from #SCOVA in the case argued last Monday (Tazewell 1). That case is about the 2025 violations of Va's constitution & laws by the Democrat General Assembly

2. In Tazewell 2, re the 2026 violations by the Dem Gen Assembly, the injunction imposed on the referendum by the trial judge was left in place last Tuesday. This tea leaf might suggest #SCOVA has decided to rule against the referendum & so is holding the referendum in place

3. Tazewell 2 was immediately appealed to the Sup Ct of Va (#SCOVA), but for tea leaf #2, no briefing schedule has been set. Like the prior tea leaf, this may suggest #SCOVA knows it will not be considering Tazewell 2 b/c they already have the votes to reject the referendum

4a. Reminder tea leaf: back in February, when #SCOVA held Tazewell 1 instead of hearing it prior to the referendum, they made a very unusual comment on the merits, saying words to the effect of "we have grave concerns about the serious issues raised in this case"

4b. That may not sound like much, but most courts don't make any comment at all when simply holding a case.

& as a reminder for those who thought #SCOVA was 'ducking' the case back then, 100+ yrs of Va. precedent says that courts shouldn't rule on referenda before the vote

Conc.: it's still my belief that #SCOVA will rule against the referendum, leaving Va. with its current 6-5 map through 2026 (at least).

I also believe that #SCOVA is trying to go fast, knowing we need maps for 2026 elections, & we could see a ruling as early as this week

9th Circuit ‘Arrives In’ Strange Place

The 9th Circuit LITERALLY allowed an immigration ruling holding "outside the United States" (but nearby) is the legal equivalent of "inside the U.S."!

25 years ago or so, when I did patent litigation, there was a case called Moore v Standard Register (Fed Cir 2000) dealing w/a patent that had a claim requiring an adhesive (ie, glue) to cover a "majority" of the length of a surface. Seems simple. Apparently not...

1/ The most recent tough-sounding @realDonaldTrump ad is an infuriatingly false pile of double bull crap.

BullCrap1-> Look at this picture of the Trump ad: Image
2/ Trump is admiring fully armed troops coming out of a helo, suggesting Trump put armed forces on our border. In fact, the “troops” he put near (not on) the border were “armed” with paperclips, staplers and laptops, along w/ the occasional deadly set of binoculars

That’s it
3/ Troops always have “Rules of Engagement.” What were Trump’s rules? Don’t engage.

Seriously. Don’t Engage. And guess what? They didn’t engage. It was a pure political show.

Look at what some of even the left wing dems say about this race and the failure of confidence in NY's election system.

First, one of the losing candidates (Wiley):
"It would be an understatement to express dismay at the BOE’s administration of this election ... Today we simply must recommit ourselves to a reformed Board of Elections and build new confidence in how we administer voting in New York City," she said.
@AOC, a Democrat representing parts of the Bronx and Queens who supported Wiley's candidacy, stood among a host of other New York Democrats who criticized the election board for its handling of the election following errors in tabulation.
