These are critical policy issues. But they're **analytically distinct** from the accusation of the Nunes Flyer. /1
The Nunes crayon-scrawled napkin claims the FBI acted in a politicized and improper manner viz. Page. What matters here is **not** whether we think FISA processes are the right ones, but whether the FBI broke with standard operating procedure in seeking the Page warrant. /2
Now, there *is* a point of intersection. If you think that the FBI behaved in a politicized and improper manner, **then the fact that the FBI got their warrant should lead you to conclude that the process does not protect civil liberties.** /3
This is an actual. substantive contradiction. It's the type that cannot be wished away. As others have pointed out, it makes the timing of #ReleaseTheTalkingPoints extremely suspect. There's no way that these guys aren't full of it, one way or another. /4
(By "timing" here, I mean the fact that it was released after the reauthorization vote. What's fascinating is that I've seen a number of run-of-the-mill Trump supporters notice this. Even if they wind up brushing by it.) /5
This takes us back to the "progressive's dilemma"—or lack thereof. The relevant issues, viz. the FOX-report-with-TS/NOFORN--on-it, are simply a) whether the FBI's application shows evidence of politicization and b) whether it matters to the Mueller probe. Not FISA writ large /6
Again, you can hate everything about FISA process—or dislike the specific authorities involved with Page—and still think Nunes' staffers are full of it. You can be extremely skeptical of the FBI **and still think the surveillance of Page was likely procedurally legitimate**. /7
So while I generally lean toward left civil libertarians on substance, but lean toward the center-left on tactics, I don't think there's really much in the way of hypocrisy to deal with here. /end
