1) I've spent the last two days poring over writings from SCOTUS cases, Presidential Opinions, Congressional Acts and Constitutional Scholars. They all unanimously say that in matters of Declared Emergency pertaining to National Security, the President has the authority... cont.
2) , with notice to Congress, to move funding from wherever he sees fit to address the Emergency. He can take it from either discretionary OR non-discretionary spending.…
3) In addition, according to the Balanced Budget and Emergency Deficit Control Act of 1985, amended & enacted Feb 9th, 2018 , upon Notification to Congress, the President can defund ANY appropriation from the Budget and return the funding to the Treasury for Deficit Reduction.
