Justices in the past have been passive because historically the Senate has conducted legitimate impeachment trials, with witnesses & documents @Mikey7314 @justbeinpetty "Senate rules" can not overrule what is in the US Constitution, they can not take away power vested in Chief Justice Roberts by the Constitution.
Of course the presiding judge can choose to defer to Senate rules and allow them to manage the trial, BUT ...
