Twitter's lawyers told a federal court yesterday that nothing in the "Twitter Files" cited by Donald Trump actually show that the social media platform was a tool of government censorship.

The Mar-a-Lago special master is telling Trump's lawyers to say once and for all whether they really think the FBI planted evidence during its search, as the former president has publicly alleged. Image Link: storage.courtlistener.com/recap/gov.usco…

A lawyer from the Texas Attorney General's office just entered an appearance in the 11th Cir. case over classified records at Mar-a-Lago. He claims to represent Texas, Florida, Indiana, Kentucky, Mississippi, Missouri, Montana, Louisiana, South Carolina, Utah, and West Virginia. Image Texas' brief is quite a document. It's basically a litany of why-Biden-is-bad-and-shouldn't-be-trusted, going through everything from immigration litigation to theories about COVID's origin to the Vice President's assertion that the border is secure. A federal court in Florida has dismissed - for many different reasons - former President Trump's lawsuit against Hillary Clinton, various government officials and various others over "Russiagate."
storage.courtlistener.com/recap/gov.usco… Judge: Trump's 193-page conspiracy allegation "is neither short nor plain, and it certainly does not establish that Plaintiff is entitled to any relief."

One of the lawyers who asked a federal court to invalidate two of the three branches of government, @kellyesorelle, says she's filed another case in the Supreme Court to invalidate the 2020 election.

I checked with the clerk today. There is no such case. This is not surprising. You can't just file a lawsuit in the Supreme Court (unless you happen to be a state and are suing another state or similar things). And even then you can't just file a lawsuit; you have to file a motion for leave to file. None of that has happened.

A large part of the totally-unsubstantiated theory that the FBI actually incited the Jan. 6 riot started with people not understanding how to read charging documents and making assumptions about their misunderstanding. And it's gone downhill from there. Guys, there were federal agents in the crowd on Jan. 6. We know because one of them, a DEA agent, was prosecuted.

Here he is showing his creds.

He was with his brother, an FBI agent, who was investigated but not charged. He even went on Tucker Carlson's show to talk about it.

Confirming @Reuters' reporting on the damage The Gateway Pundit caused, the site re-upped false claims that two GA workers had rigging the 2020 election. They've been in hiding over numerous threats.

"The Gateway Pundit NEVER condones threats or violence but ..." Image The election-rigging claims against the two GA election workers are false. The Gateway Pundit has aired them repeatedly anyway, prompting death threats. Even now, a year later, people are still repeating these false claims online.

Here's a fascinating story from the @journalsentinel about the supposedly independent 2020 election review being conducted for Wisconsin's legislature. jsonline.com/story/news/pol… One of the people hired to work as an investigator on the review is the head of a group that sued to overturn the results of Wisconsin's presidential election - twice.

Pillow magnate Mike Lindell has posted a copy of his long-promised election-overturning Supreme Court complaint on his website and it's missing a few things you commonly find in lawsuits, such as a plaintiff and lawyers. The claim seems to rely on an Electors Clause theory that the Supreme Court declined to hear last year and a state standing argument that it rejected when Texas sued. And until [insert Your State] agrees to file, the court wouldn't have jurisdiction anyway.

The @rcfp has asked a federal court to unseal FBI's applications for the search warrants it used to seize Project Veritas founder James O'Keefe's phones.
storage.courtlistener.com/recap/gov.usco… DOJ told a court its warrant applications for James O'Keefe's phones should remain secret: "this request encompasses materials that, if disclosed, would reveal a substantial amount of non-public, sensitive information that would jeopardize an ongoing grand jury investigation."

DOJ opposes James O'Keefe's request that a court appoint a special master to review materials the FBI seized from him. It says there's a big First Am. difference "between stealing documents and disclosing documents that someone else has stolen previously."
storage.courtlistener.com/recap/gov.usco… Most of the detail is redacted, but DOJ is pretty clearly alleging that it has evidence Project Veritas had a hand in the theft of Ashley Biden's diary.

The twenty-third rule for Trump's planned social media site is that you can't use it to make fun of his new social media site. The terms of service also include a forum selection clause pretty similar to the ones Trump's lawyers just got done arguing are unenforceable. (They've lost on that in one case and two others are pending.)

Today's Senate Judiciary report has a remarkable inside look at the final weeks of DOJ during the Trump administration. ->

New from @reuters: One America News, the right-wing cable network that peddled 2020 election conspiracies, gets nearly all of its revenue from AT&T.

reuters.com/investigates/s… OAN's chief executive, Robert Herring, helped AT&T lobby the government to approve its merger with DirecTV. Herring's lawyers said he "invited AT&T to utilize OAN’s news programs to cast a positive light on the acquisition."

"In both counts, Biden wins." A spokesman confirmed to @kjzzphoenix that the Arizona Senate's election audit basically matched the official results (Biden actually did slightly better.)

"Was there massive fraud or anything? It doesn’t look like it," he said.

Trump's lawyers told a federal court tonight that Twitter's forum-selection agreement -- which requires that he sue the company in California (not Florida, where he sued) -- does not apply to him "as the 45th President of the United States." Trump's argument seems to be that his Twitter account was actually operated on behalf of the government, inasmuch as he made announcements about policy. And Twitter's TOS don't apply to government entities that cannot accept venue limitations.

(@Reuters) - Three former U.S. intelligence operatives, who went to work as mercenary hackers for the United Arab Emirates, face federal charges by the U.S. Justice Department, according to a court docket created on Tuesday. Background: American hackers used state-of-the-art cyber-espionage tools on behalf of a foreign intelligence service that spies on human rights activists, journalists and political rivals.

The Arizona Senate released a big pile of records related to its election audit last night, in response to litigation by @weareoversight. If you have an appetite for a 4gb zip file, it's here: statecraftlaw.app.box.com/v/senateauditp… Looks like the chair of the Arizona GOP had pretty extensive interactions with the gov't liaison for what the Senate claimed was a non-partisan audit, including arranging Newsmax and OANN hits for him.

The America Project put in more than half of the money for Arizona's audit. Its website leads with a video from Mike Flynn saying our nation is "under a new type of attack."

Another $550k came from Sidney Powell's group she's facing possible sanctions for her election suits. The America Project, Inc. is a Delaware corporation formed in late April, whose registration appears to list no officers. Its contact address is a UPS Store in Tampa.

One of the lawyers in the "Kraken" lawsuit says they can't be sanctioned for their failed effort to overturn Michigan's election, citing as authority "cases too numerous to mention and any attempt to string cite them here would be insulting to all involved." The lawyer who filed this is actually represented by another lawyer at this point, but the lawyer for the lawyer didn't file it. storage.courtlistener.com/recap/gov.usco…
