The best that our best legal minds keep giving us are 5-4 decisions. 5-4 might be a majority, but it it’s not a victory. It’s a goddamn stalemate! It means you have to go back to the drawing board not the champagne celebration.
It means half the country is at best confused, at worst, enraged. We must learn to rule by consensus for things that count. Otherwise, a group of white guys will get to determine the fate of women. Does a woman have a right to determine what she does with her own body or not?
I would take the #AlabamaAbortionBan seriously, philosophically speaking, if it involved punishment for the woman seeking the abortion (it does not). Instead, it demonizes doctors, who could face life in prison for providing abortion services.
If abortion is, indeed, murder, then why would the woman not be punished? This would be like arresting the hit man, while letting the man who hired him off scot-free. Are women not conscious actors, willfully making decisions?
Are doctors not simply following the hippocratic oath (“do no harm”) by providing abortion services? A determined woman will terminate a pregnancy by whatever means. A doctor providing an abortion allows her to accomplish this in the safest, most humane environment possible.

I know from my own children and their friends we are winning the culture war on late-term abortion. I think if they had banned late-term we might even win that at the supreme court level. /2
I think leaving out an exemption for rape or incest is also a plank that the liberals will beat us over the head with. Rape/Incest is less than 1% of all abortion and technically it could be considered health fo the mother issue. / 3
