BODY CAM PHOTO: When Deputy Brown found #SuzanneMorphew bike on May 10, 2020. He observed there was no damage to the rim or spokes, which he expected to see if the brake had locked and the weight from a rider would have been going head first over the edge.
I am inside the courtroom for #BarryMorphew preliminary hearing ruling that will begin at 1:30 p.m. His family and attorneys have been seated. His daughters are sitting on the second row and his sisters/mom are on the third row. The judge has not entered yet. @FOX21News
There is more Security today than the previous 4-day preliminary hearing. It is taking people a lot longer to get into the Chaffee County Courthouse. There are about 8 seats available for the public.
#BarryMorphew is now entering the courtroom. He is wearing a light grey suit and cowboy boots again. He walked in with a folder with papers. He is wearing a blue medical mask.
According to Grusing, #BarryMorphew said all he had left in his life was hunting. Barry had hunted since he was 7-years-old. "If I have to live this life without her, at least I can hunt."
Agent Grusing said #BarryMorphew mentioned multiple times during the investigation that "This is in God's hand. He allowed this whole thing to happen."
Agent Grusing road in the back of the car when #BarryMorphew was arrested on May 5, 2021. Morphew said, "How could you do this to me? I trusted you."
Talk about Divorce: Agent Grusing said #BarryMorphew would tell #SuzanneMoprhew "I'm not discussing this, cause it is never going to happen." The state said, "It never did."
Agent Grusing asked #BarryMorphew about him ever being physical with #Suzanne because one of the 50 grievances was just wrestled free. Barry said he never grabbed her or constricted her with his arms. She would brush up against her.
April 22, 2021 interview with #BarryMorphew Agents said you were the last person to see #SuzanneMorphew alive and Barry agreed.
#BarryMorphew asked Agent Grusing if he could have immunity if he gave them his life up?
Agent Grusing asked #BarryMorphew about the tranquilizer... when it was last fired? Nielsen is wanting on the record that the state should be asking questions and Agent Grusing should be answering, not the other way around.
Former FBI Agent Grusing said #BarryMorphew said it was last used in late April.

Exhibit 96,97: Photos of the "chipmunk gun" The barrel is 7.5 inches long. #BarryMorphew handed the gun to Agent Grusing through the window of his vehicle.
The state is asking Agent Grusing when he interviewed #BarryMorphew. Barry sat up in his chair and crossed his arm. Agent Grusing was called to help investigate Barry. The state is asking about Grusing strategy about interviewing Barry.
NEW WITNESS: CBI Agent Kevin Coback. Field agent in Pueblo for 7 years. D.A. Linda Stanley is now asking him questions about #BarryMorphew employee Morgan Gentile.
#BarryMorphew was supposed to pick Morgan Gentile up on Sunday night at 5:30 p.m. but didn't and called her around 11 a.m. to ask her to bring another worker to Broomfield.
Morgan Gentile stayed in room 228, Jeff Puckett stayed in room 225 (room that #BarryMorphew had stayed in). Judge is asking if the room had been cleaned before Puckett arrived, the investigator didn't know.
Now they are discussing the marks on #BarryMorphew marks on his hands and arm. Eytan wants to know the measurements and Rohrich doesn't know because he said he didn't measure the three markings (fingernail injuries he had testified to).
Eytan said when people disappear they don't always use their identification so if #SuzanneMorphew disappeared she wouldn't use her ID. When referring to Suzanne leaving her purse in the car.
Suzanne's cell phone was not found in the investigation. Her phone charger was not at the home either which would have been at her bedside.
Back on the record: Undersheriff Andy Rohrich is on the stand. #BarryMorphew took off his suit jacket and rolled up his sleeves. He tucked in his shirt when the judge entered the courtroom.
Eytan is asking him about the sleeping bag found near #SuzanneMorphew bike. It wasn't tested for DNA. Undersheriff Rohrich suggested it could have flown out a bed of a truck.
#SuzanneMorphew bike had DNA of #BarryMorphew but not on the handlebars. Rohrich keeps telling Eytan that he doesn't know where on the bike that Morphews DNA was located.
Eytan is now cross-examining Undersheriff Andy Rohrich. She is asking if #BarryMorphew followed the deputy task when he entered the home. He agreed he followed the directions to go into the home and find a place where she is wearing something and points out Suzanne's clothing.
Attorney Eytan is reminding the undersheriff that #BarryMorphew when he was first contacted by deputies that he was very emotional.
Now speaking about prescription drugs found in the #Morphew home and Walmart surveillance on May 6 at 12:30 p.m. of Suzanne picking up a white paper bag at the pharmacy but none found in the home for that date.
EXHIBIT 85-87: Photos of #BarryMorphew hands and arm with injuries. According to Undersheriff Rohrick, Upper left arm looks like there are fingernail injuries. 3 abrasions or cuts scabbing over. Outside of his hands were injuries in various stages of healing.
Exhibit 88-92: Surveillance photos from Highway 50 at a Shell Gas Station, Salida Auto Sales, and home near DSI.
On 1:51 p.m. on May 9, 2020 the photo shows #BarryMorphew pulling his bobcat into DSI. He was wearing a blue t-shirt and khaki shorts.
The state is asking the undersheriff about hunting. Asking if he knows when elk shed their antlers. Undersheriff Rohrich said they typically shed their antlers before March and that Bulls and Cows aren't typically together in May. #BarryMorphew preliminary hearing.
Undersheriff Rohrich is now talking about tranquilizer darts and guns. He has used them for four years. Explaining how you use them putting the solution in the dart and then put it in the gun. He used them for vicious dogs when he was animal control officers.
He said that more times than not he would have to chase after the dog after shooting it with a tranquilizer dart. Sometimes the dogs would be found in peoples yards later and he would be called. He would also catch cats.
We are about to watch exhibit 94 which is body cam video of #BarryMorphew entering the home identifying the clothes of #SuzanneMorphew. This is the one and only time he was allowed into the home after Suzanne was reported missing.
The video starts on May 10 at 9:37 p.m. he starts in the driveway and walks down to the home with a deputy.
#BarryMorphew is wearing a long sleeve red and blue flannel. This is the first time we are watching video of inside the Morphew home. He heads into the home and takes a left into a closet and points to clothing then Barry is seen going to the kitchen to get a plastic ziploc bag.
Back on record: NEW WITNESS takes the stand. Chaffee County Sheriff's Office Undersheriff Andy Rohrich. He has been the undersheriff for 3 years. He has been a police officer for 23 years. He worked as an animal control officer for 4 years. #BarryMorphew preliminary hearing.
Undersheriff Rohirck was called while off-duty around 8:14 p.m. May 10, 2020, about #SuzanneMorphew and got on scene around 8:52 p.m. #BarryMorphew drove to the scene 5 minutes before Rohrick got to the scene.
Undersheriff Rohirck is looking at photos taken of #BarryMorphew truck. Describing the cab of the truck as dirty, dusty, clutter with some clothes and his bag he had taken to Broomfield.
#SuzanneMorphew SPY PEN: Found in the master bedroom closet that was all female clothes. It was found in a box of bras. A picture of the pen was shown to Agent Graham.
Pictures of the Laundry room and contents in the dyer: Clothing, sheets, a cap for a syringe for a dart were found inside the dryer. Agent Graham is confirming in #BarryMorphew Preliminary hearing day 3.
Agent Graham said there was one box of syringes inside the safe in the garage as well as several darts. Photo of the garage with safe open is shown to Graham. #BarryMorphew Attorney Iris Eytan will cross-examine Agent Graham now.
#SuzanneMorphew had been at Gene Ritter's home (neighbor) for coffee from 9 a.m. -11 a.m. on May 6, 2020. During the time of "I'm done" text was sent to #BarryMorphew.
Nielsen is going over the timeline of events with Grusing, according to text messages, FB messages, truck data. The state is telling the judge that Agent Grusing didn't go over the text messages between #barrymorphew and Suzanne. The judge allows the timeline to continue.
Grusing was asked about the 18-19 miles that were missing from #Barrymorphew odometer in his truck. Nielsen is talking about where Salida Stove and Spa is located and asked if it is a coincidence if the location to the spa is the same amount of missing miles, "No," Grusing said.
Nielsen is talking about what #BarryMorphew allegedly threw away at the trash runs. Made it known there were no pictures or video of him throwing away things at the Broomfield bus stop.
Trash run #3 is the first time investigators have photos or video of #BarryMorphew throwing away items. "I am a tightwad and I don't want to pay for trash pick up." He allegedly told investigators. "I work so much where my truck becomes a trash truck."
Investigators don't have photos or videos from the Men's Wearhouse trash run. The plastic tree pot #BarryMorphew allegedly threw away at the hotel is one similar to the one he buys at a nursery in Salida.
Defense Attorney Neilsen is poking holes into Agent Grusings evidence of when #BarryMorphew put his cell phone on airplane mode on and off. Which is mentioned in the sealed arrest affidavit.
Verizon records show #BarryMorphew cell phone at 7:19 a.m. on May 9 receiving a signal. Neilsen asked, "Can a phone receive a signal in airplane mode?" Grusing said, "I don't know."
The state has been objecting to many questions due to repetitiveness. The judge agrees. Neilsen continues.
#BarryMorphew First interview with Com. Walker, Morphew claimed on Sunday morning, he set his alarm for 4:30 am. He had already loaded the truck the night before. Left the driveway around 5 a.m.
Takes about 32 minutes to drive to Johnson Village from #BarryMorphew home. Neilsen said this is according to Google directions. Based on phone data, he is in Johnson Village at 5:37 am.
"Do you think there is time to dispose of a human body in that time?" Neilsen asked. "No there is not," Agent Grusing replied.
Agent Grusings theory is that #BarryMorphew did something to #SuzanneMorphew when he got home on May 9. Chasing Suzanne around the home while she is concious. The push pin map that they presented said it isn't possible for him to move at 45 miles per hour, according to Neilsen.
"At 2:45 p.m. #BarryMorphew did something terrible to his wife and then went to get his hot tub fixed?" Neilsen asked. Agent Grusing responded, "I don't think their timing is accurate." (referring to Salida Stove and Spa)
Neilsen is going over the truck data again with Agent Grusing. BERLA report from 3:25 am - 3:49 am total of 7 door events and 6 parking lights events. Indoor lights are also considered as parking lights.
According to an employee at Salida Stove and Spa, Neilsen said from an interview with investigator Derek Graham #BarryMorphew visited on May 9 between 4 and 5:30 p.m. That there was nothing unusual about his demeanor.
#BarryMorphew had a convo with Janelle and Colton Nebal at the store, according to Neilsen. She is questioning Agent Grusing on his timeline. On May 8, Morphew sent a message to Colton around 1:18 p.m. about getting his hot tub fixed. Asking when he could come out to the home.
There were 19 miles that were unaccounted for when #BarryMorphew went to Broomfield. Neilsen said this Salida Stove and Spa trip could account for 18 miles.
Court is back in session for #BarryMorphew Prelim DAY 2! Agent Grusing is still on the stand. Attorney Neilsen is cross-examining him.
Neilsen is going over the truck and cell phone data again on May 9. At 1:55 p.m. door opens at DSI and there is surveillance video as well.
At 2 p.m. #BarryMorphew was getting his blade replaced on his bobcat. on Saturday, May 9.
Attorney Dru Neilsen is now questioning Agent Grusing. They are looking at #BarryMorphew phone records proving that Barry called Suzanne as he drove home from Broomfield. No answer.
May 10: #BarryMorphew called #SuzanneMorphew at 11:20 a.m. then called Mallory at 12:06 p.m.
Agent Grusing helped write the 129-page arrest affidavit. #BarryMorphew spoke with LE 23 times. Barry didn't LE until Feb. 28, 2021, about the chipmunks 9 months after #SuzanneMorphew went missing. (reference about phone pinging outside the home)
Investigators' last interviews with #BarryMorphew were April 5 and April 22.
On May 9, #BarryMorphews phone is pinged near the river behind his home. Investigators asked why this was, his response was, "I was looking for a turkey that Mallory had shot some time ago." 11:50 a.m. - 12:50 a.m.
#BarryMorphew left the home around 1:38 p.m. #suzannemorphew sent a message to Libler saying "Guess who is alone again?? at 2:03 picture was sent sunbathing.
