1. They way I interpret the Flynn memo on his FBI questioning on Jan 24, 2017 is that he knew they were FBI special agents (all that I think is necessary to tee up 18 USC 1001) and that he lied to them about material fact[s] (all that I think is necessary to charge).
2. I presuemt the Judge knows what facts were misrepresented. And I still don't think it was the sanctions. I think it was some business related secret. Trump Tower Moscow perhaps. Or, what I call the #BlueWhale.
3. Certainly a former DIA officer knows about 18 USC 1001. Pretty sure lying to a DIA agent in performance of their official duty is 18 USC 1001 violation.
