Rosenstein had just written the memo to fire Comey.

The political world was on fire.

The idea that in that moment all things considered Rosenstein could’ve stepped to the mic and announced no there there and closed the investigation politically is fantasy.
By doing that Rosenstein would have turned McCabe into a “whistleblower” on million times worse than anything we have seen with the others. A “deep throat” spewing stories of Trump “collusion” with the veneer of Trump “obstruction.

It would have supercharged things.
Instead of opening McCabe up for investigation, which is what happened the day after Mueller was appointed, it would have provided McCabe a protection he didn’t deserve and would have complicated the entire process of investigating the investigators.

1/ I’ve been explaining this for a long time. This thread synthesizes it. IMO Trump and Flynn strategized the events around the call to Kislyak in order to force McCabe and Yates into overreacting. Trump seemed vulnerable. In order to get Trump they were baited into illegal acts.
2/ And by the way the General Flynn, Ambassador Kislyak call was leaked to David Ignatius of the Post is in fact the subject of one of the criminal investigations because that leak is a 20 year felony.

3/ During the transition a plan was developed to trigger a series of bait traps. I speculate that in the face of a corrupt DOJ/FBI Trump had no choice but to run some of these investigations himself. Centered with the WH. Possibly using Secret Service.

1/ Here’s a point that hasn’t been highlighted enough.

The argument that Mueller makes in the obstructions section of his report actually reinforces how fully the first part of his report exonerates Trump.
2/ In the presence of evidence of any kind, Mueller argues it’s inappropriate to to make a charging decision against a President because he’s denied a venue to defend himself.
3/ The corollary that applies to the first section of Mueller’s report, is that there was no need to withhold a prosecutorial decision because there was no evidence of conspiracy to coordinate with the Russians.

1/ What Trump did was risky. Starting with nominating Rosenstein. At the height of the resistance he appointed a person that was confirmed 94-6. Rod wasn’t in the bag or a wingman. He was going to call balls and strikes. Do things by the book.
2/ People say Trump didn’t know Sessions would recuse. I disagree but maybe he didn’t. But to appoint RR DAG you would have to be 100% confident Sessions wouldn’t recuse. Or you were putting yourself at risk. IF! If you had done wrong or feared the deep state.
3/ Then not only does Trump not fire Rosenstein after he appoints Mueller, he also rebuffs an offer from Sessions to resign. As early as May of 2017. So Trump decides to leave things as they were. AFTER Mueller was appointed.

1/ I think we should open a discussion on the best structure for #Phase2. Let’s start with the biggest difference between 2019 and 2017. Every Republican is now reading from the same playbook.
2/ That’s right. Of all the benefits of a #CleanBillOfHealth the biggest regarding #Phase2 is that now all Republicans know Trump Russia was BS. Yes it was always obvious but for some Republicans they couldn’t afford Mueller undercutting Trump.
3/ Having Mueller in the rear view mirror is a huge benefit as we move forward. The last thing we need is a Republican questioning the process. Party unity is a crucial component in successfully executing #Phase2.

1/ If I am correct that from as early as the transition and then from the first days of Trump’s administration there was an investigation of the coup plotters being run out of the WH, then this testimony is more significant than people realize.
2/ “Flynn lied!” Just look at how McGhan interacts with Yates. He’s careful, gives nearly nothing and questions her. He forces her to explain why she’s doing, why and to provide the evidentiary basis.

2/ Actually @AndrewCMcCarthy, I think it was very important for every investigative avenue to be fully explored before Mueller ever commented on anything. When he publicly gives @realDonaldTrump his #CleanBillOfHealth it’s crucial his report is a gold standard and bullet proof.
3/ Andrew opens the door into #Phase2. Now you can see why completing Mueller’s #CleanBillOfHealth first was so crucial. It actually makes plain that the DOJ/FBI we’re acting corruptly.

Let’s just say that for folks like McCarthy the surprises have just begun.

1/ Here’s the transcribed Trump quote from last night. If you’ve been reading my TL, this is what I’ve been explaining. The firing of Comey launched a sting on McCabe who predictably did what they expected and opened inappropriate investigations against POTUS.
2/ I want you to take notice that Trump names exactly who “did it” and he does not mention Rosenstein. The reality that there was a sting run by DOJ, where McCabe was the target triggered by Rosenstein’s letter and Comey’s firing, is now nearly impossible to deny.
3/ The investigation targeting McCabe would’ve been viewed as obstruction if McCabe would’ve continued as the head of the investigations that he launched after Comey’s firing. There was only one way to pull the plug on McCabe and avoid obstruction claims.

Appoint Mueller.

1/ This clip dovetails many aspects of what I’ve been speculating for quite some time. I think it makes sense to update my views in light of the IG report. Note he says he has purposely stayed out of DOJ decisions to avoid the optics that he is interfering.
2/ It’s been clear to me since the beginning that Trump knew Sessions would recuse or at a minimum that there was a high potential he would. In the environment he appointed Rosenstein AAG. Not a crony, not an ally. No, a non partisan independent actor.
3/ In his comments yesterday Trump acknowledges he set it up in the way he did to keep the media from being able to say that he was interfering. It has been a conscious choice. But he also says he could interfere at any time. This is where Pruitt is key.
