Great example of why after #Brexit the UK won’t be able to just wave goods through and we will need #customs formalities AND checks, incl for NI to GB trade. Especially if we want to sign FTAs.

It can be daunting if you don't know where to start. Especially when it comes to the "forgotten tax" - #customs. Companies often don't have an in-house customs team. Either outsource the function to brokers and agents or have someone who "also does customs".

Internal customs processes are often followed blindly without a full understanding of why all the steps need to be taken. Which is understandable without a wider trade/customs context.

This is interesting. On #customs and #tech. Turkish customs added X-Ray Vehicle and Container Scanning (with some AI) systems to analyse vehicles and containers without physical intervention – just a scan to see what’s/who's in them

Also, notice how these are implemented in a wider system – scanners, IT system, data processing and analysing centre. All this needs to be designed and planned before you can implement new tech

On the summary exit declarations, @SteveBarclay mentioned today. It's important to understand what they are, why they are submitted and how they differ from #customs declarations.

@SteveBarclay Exit/entry declarations are slightly different than customs decs. Before import/export there is a requirement to submit a pre-arrival, pre-departure notification - info that allows authorities to control what's moving across borders from a safety and security perspective.

@SteveBarclay This information is mainly used for risk analysis and not to calculate the amount of duties due or apply other trade policy measures as in the case of customs declarations.
In principle, they are submitted by the carrier not the importer/exporter

In response to @Jim_Cornelius' tweet a longish one on @GregHands interview on Newsnight last night (and the proposal in general).

TL:DR I get what they are trying to do but I have some genuine questions/concerns /1
@Jim_Cornelius @GregHands On the proposal and the integrity of SM – yes the proposal protects it in theory, on paper. But 1) smuggling will be hudge problem - how will the revolving patrol know if the car they stopped is an SME who is exempt from customs procedures and tariffs or a smuggler?

@Jim_Cornelius @GregHands 2) Requires the EU to agree to unprecedented derogation from the UCC. Both in terms of how existing procedures work & exemption for SMEs. Think of it this way – customs declarations thresholds are going down in general.

Apart from not meeting any of the conditions an alternative arrangement was supposed to met (apart from a super narrow definition of no checks AT the border) I have two main problems with this new proposal /1
1) It doesn't provide any simplifications for SMEs and makes it much harder and expensive for them to trade. In the absence of a trusted trader programme that would work for SMEs, they can either use transit or submit a pre-lodged customs declaration /2
Both option require SMEs to use services of a #customs agent which can wipe out the entire profit margin (if you can find one that is, as this industry not currently developed in the area as not really needed until now) /3

With a common SPS zone +regulatory regime for industrial goods, what happens to the border?
If the UK is out of the CU+SM there is a customs border between NI and ROI. Regulatory alignment changes nothing here. /3

#Customs Academy launch. If there is one thing we need in the UK it's more customs education and training. Brexit or not, customs is an area worth exploring.

The import /export #nodeal flowcharts published yesterday/today are very important information.
But if you are already trading there is very little new info there (if any),
And if you aren't, there is very little you can do with the flowcharts /1
If you're a new importer/exporter the flowcharts can demystify the process but you will still need to understand what #customs info you need to provide and how to get it. /2
You will still need a customs broker/agent or a freight forwarder to help you /3

The expression used in the letter "deal with customs processes" is clumsy but /1
To explain who needs only UK EORI and who needs both UK and EU one you need to first explain basic customs principles: importer/exporter, special procedures, incoterms etc /2
The UK/ EU EORI issue would be best explained by a series of scenarios but even then it really is a case by case issue. Bit easier for smaller companies but still something a trader needs to assess given their current circumstances, model, future plans etc. /3

2) How do you know you're one?
3) What is the liability and responsibilities in both cases?
4) What are import/export procedures?

UK freight forwarders/ brokers cannot recruit #customs specialists in sufficient numbers. The same way UK Gov cannot hire customs clerks, customs officials and the 500 border force officers Sajid Javid promised /1
First, as many incl @LeftPeggers pointed out, we don't have them in the UK (#customs is country specific, to a certain degree even within the EU, also not sure EU customs ppl would want to come work in the UK). /2
@LeftPeggers Second, customs is not something you can learn from a book as a lot of it requires direct experience. It's very different from other areas of tax where most rules are written down clearly (which still of course require direct experience)- customs rules are ambiguous at best /3

Great one on #backstop. The only thing is, backstop doesn't remove the need for #customs procedures. Under the backstop an A.UK document would be needed. That's similar to what Turkey currently has under their CU with the EU /1
For Turkey you currently also need a pre-notification and a #customs declaration. The backstop DOES NOT clarify what customs procedures other than the A.UK doc would be required. Not enough details to be able to say how frictionless borders would be /2
I hears customs declarations would be removed but the need for pre-notifications would stay. But bottom line is we don't know what customs procedures would look like under the backstop / end

I wouldn't even say that's the main problem. Have them. Why not? All #customs simplifications are good. We have I/O processing, warehouses, end use etc. Free ports could be useful for a very limited number of companies that happen to be located in the right place /1
Building them, putting the right processes and controls, hiring staff and ensuring compliance will be a big investment that may or may or may not be worth it in the long run /2
But for me the main problem is that if he's mentioning #Freeports on day 1 the chances are he doesn't really understand what they do. Seems he's been advised it's an opportunity that somehow relates to #Brexit /3

Some like the #AAC claim that it would be sufficient to use existing systems and processes to solve the NI border. All you would need is to adapt them slightly. Which doesn't seem to be a big deal (I'm not going to go into detail here on the AAC plan-just focusing on systems) /2

Much on free ports /zones over the last couple of days. The only thing you really need to know about them is that they have absolutely nothing to do with the most pressing #Brexit challenges
These remained unchanged since well before March –NI border, customs procedures, delays, business readiness etc. Free zones/ports change very little here.
The issue of whether or not EU membership has prevented us from having free ports/tax free zones is completely irrelevant (also- it hasn’t).

The thing about #customs declarations, whether you think they look difficult or not, is that to answer most questions you need to be familiar with customs rules as well as legal implications of your answers /1

No, it’s not rocket science but it’s an area of tax and like all tax matters is not particularly user-friendly and straight forward. Does it matter who you list as the declarant? How do you calculate the customs value and why does it matter? /2
You really need someone within your company with some idea of what it all means. Even through you’re most likely going to be using a broker. Because even though they are familiar with the rules, it’s not their job or responsibility to advise you on them /3

An article about a country with 3 separate customs territories – China. #FTAs in place between the Mainland and Hong Kong, Mainland and Macao and Hong Kong and Macao /1

Basically: China is one country with separate customs territories which are joined by FTAs – in order to move products between these territories firms need to comply with #rulesoforigin
So the Chinese “one country, two systems” system is not without price. /2
It is as if post #Brexit NI and GB were two different #customs territories within one country, joined by an FTA and with rules of origin and other customs formalities between them- with an actual customs border. Just something to think about
