🚨MAJOR update for #DV2020 & #DV2021! Many thanks to @curtisatlaw for posting!!!

1. Govt has completed the IT "updates" so they will be ready to process reserved visas in Gomez/Goh/Rai/Goodluck/Filazapovich IF APPEALS are SUCCESSFUL ....
2. As we all suspected the updates were minor. It appears that it involved the ability to re-upload DV cases from prior years and be able to differentiate between "active" (meaning #DV2022) and "inactive" (#DV2021 and #DV2020). Running of the script at posts will take minutes.
3. It sounds like in the process of doing this modifications to the system & software DOS has actually gone through the prior cases. And DOS has now "deployed" 36,872 cases of #DV2020 and #DV2021 selectees in "inactive" status.

Fundamentally, this is a demand-supply and allocation issue. The number of #GC annually given out has not changed meaningfully since 1990. Meanwhile the US economy and labor market today are completely different from back then. 2/9
On top of this supply issue of #GC is the fact that their allocation is not equitable. How long you wait in line, usually boils down to the country you were born in. Not on skills, education, work experience, duration of stay in the US or contribution to the economy. 3/9

BREAKING: DC Circuit just sent the Gomez Appeal back to the district court to determine whether "interim relief" is due and whether Government intends to "enforce" PP10014.

The order specifically references the R28j letters which were regarding the expiring/expired #DV2020 visas. Govt argued that nothing was done after judge Mehta invited parties in Gomez to address the issue. Now District Court is sending it to the court to decide the issue.

The Top 10: What can a President Biden fix on January 21, 2021 (let's give him one day to celebrate):

1. Undo all of the travel bans affecting millions of Americans and their families (by EO or Proclamation);
2. Order @StateDept to begin liberally issuing F-1 visas again;
3. Order @USCIS to reinstate DACA AND expand eligibility to anyone who arrived prior by 1/1/2016;
4. Reinstate TPS for everyone cancelled by Trump;
5. Notify Congress that he intends to recapture the #DV2020 visas not timely issued by @StateDept;
6. Notify @USCIS and @StateDept that derivatives are no longer counted against the allocated visa numbers in Employment and Family based categories;
7. Announce that @USCIS and @DOL will be withdrawing any regulations issued or published within the last four years;

#DV2020 visa holders,

even though #JoeBiden is now the president-elect the PP10053 and PP10014 entry ban remains in effect until the end of the year! Please, please do not attempt to use visas annotated "subject to PP10014" before January!
The likelihood that you will be able to board a plane a minuscule and even if you somehow managed it, you risk having an overzealous CBP ofc canceling the visa and putting you on the next flight back! Even worst you risk a 235b expedited order of removal.
We should hear soon from Judge Mehta on our challenge to the national interest waiver application to #DV2020.

Some potentially REALLY really good news in the PP 10052 & 10014 Litigation in DC with respect to #DVLottery Ban: order is unredacting two bullet points that Judge think are going to redressibility. Since standing could be the only sticking point ... fingers crossed.

What have @curtisatlaw and I learned from the @StateDept production of the Certified Administrative Record regarding the policies, procedures, and practices suspending adjudication of DV-2020 applications? #DV2020
Since as early as March 20, 2020, @StateDept had suspending most preprocessing of #dv2020 apps at the KCC. (20 STATE 30920 ¶ 6). KCC will resume only when a US Embassy or Consulate is authorized to resume routine services.
This means if your application was NOT documentarily qualified and scheduled for an interview, @SecPompeo has taken no action on your case.
