🧵: reiterating the point that the @NCBEX and bar examiners like @il_bar have known/should have known that the October 2020 remote bar exam was a VERY risky move for MONTHS + what they can do about it now. 1/n

On August 6, @Extegrity released a statement through @BarExamTracker saying that it would not participate in the remote bar exam.

Extegrity informed the jurisdictions it had been working with of this on July 27 and the @NCBEX on July 28. #barpocalypse 2/n
On August 4, a week after the @NCBEX learned that one of its 3 approved vendors did not believe that the remote exam was feasible as currently planned, NCBE Trustee/ NCBE's ABA House Delegate Bucky Askew opposed the discussion of/vote on @ABAhod Resolution 10G. #barpocalypse 3/n

Of allies, opponents, and enemies: a thread. As expected, @NCBEX will formally oppose (through a "motion to postpone") #Resolution10G at tomorrow's @ABAesq house of delegates meeting. This is in blatant disregard to the interests and passionate voices of our grads; and also in/1

3/resolution is too little, too late," I urge you to think about this: NCBE is not content to just beat down this small effort by the ABA. They will continue to mount opposition in every state--opposition to #diplomaprivilege, to portability in scores, and to anything that/3

I proudly endorse this call for #DiplomaPrivilege by my @FordhamLawNYC student @WPeriyasamy (w/ @MKCunningham91 @dp4ny).

"The only compassionate and equitable option for New York’s future lawyers right now is diploma privilege."
2/ "Under diploma privilege, applicants can be admitted to the bar w/o taking a bar exam but successfully graduating from law school & satisfying certain other requirements like passing the NY Law Exam & MPRE and completing a 'character and fitness' assessment."
3/ Most people don't know the history of the bar exam requirement.

For most of American history, most people became lawyers w/ neither law school nor a bar exam, but by "reading law" under a lawyer's supervision and a judge granting privileges to appear in his court...

While states are debating whether to extend the #DiplomaPrivilege to 2020 law school graduates, here are a few thoughts on the broader debate over what barriers should be in place to practice law. (Thread.)
In most states, I gather there are two major limits. 1st, everyone has to pass the bar exam to practice. And 2nd, everyone need to get into and graduate from an ABA-accredited school -- a process that requires schools to have a certain bar passage rate. americanbar.org/news/abanews/a…
Proposals to have a Diploma Privilege raise really interesting questions about whether these barriers should exist, and if they shouldn't, what if anything should replace them.

I have participated for months in the Oregon and broader #DiplomaPrivilege conversations. For those advocating for diploma privilege, I thought you might appreciate the views of one dean. With thanks to @sjdprods & @profdaf who helped guide my thinking, let me offer a thread.
As a law school, we were confident that our graduates could pass the bar exam--under pre-pandemic circumstances. But, to state the obvious, the conditions for the upcoming exam will be, at best, uncertain.
To be sure, the Oregon Bar did its best to provide a socially distant exam, as I'm sure all bar examiners will, but neither we nor any Bar can be confident about how the public health guidance will shift between now and later this month.
