🚨🚨🚨Guys please please please spread this

U.S. Congress has reintroduced a bill called the #EarnItAct.

This is the most dangerous bill I have ever seen when it comes to online privacy and free speech. Essentially, it's going to censor the entire internet. Thread: Image
This bill kills Section 230 and encryption, meaning that mass censorship and surveillance is going to happen to everyone everywhere, all in the name of "protecting kids online from CSAM". Sound familiar??

Here's a link to the post:
reddit.com/r/trans/commen…
The bill creates a 19-person commission called NCOSEP led by the DOJ and @NCOSE, a conservative anti-lgbt anti-sex group that was known as Morality in Media before they rebranded in 2015 as "anti-trafficking", yet they still meet with extreme homophobes

🧵Okay it's #ElectionDay (go vote! voting is a valid harm reduction strategy.)

I know this birdsite is going to hell in a handbasket, but while we're all still here, I put together a THREAD on what the midterms will likely mean for tech policy fights that impact human rights.
This is going to be a bit of a ruthless analysis of how I see the election results impacting hot button tech policy issues like Section 230, content moderation, privacy legislation, the FTC and FCC, antitrust and Big Tech accountability, etc.
I'm not gonna spend as much time explaining the substance of each issue, more just how the political dynamics around them are likely to shift depending on the makeup of the House and Senate. But I'll try to link to relevant campaigns / news coverage to dive deeper.

This is Patrick A. Trueman, the president of NCOSE, one of the biggest backers of the #EarnItAct

He doesn't mention this in his bio, but he used to help run the American Family Association & Family Research Council, far right anti-LGBTQ orgs that the SPLC considers hate groups
The American Family Association opposed the repeal of sodomy laws, believes homosexuality is a sin, and has led boycotts of brands simply for including gay representation in advertising.

Somehow they also blamed the Holocaust on gay people? Read more: splcenter.org/fighting-hate/…
Family Research Council is notorious for pushing junk science and disinformation as part of their attacks on LGBTQ+ rights. They regularly conflate homosexuality with pedophilia and predatory behavior, and even were in communications with KKK leadership. splcenter.org/fighting-hate/…

BREAKING: the #EarnItAct just passed out of the Senate Judiciary Committee on a "voice vote," but the good news is that FIVE Senators raised significant concerns about the bill. We still have a chance to stop this before it hits the floor.

Retweet! NoEarnItAct.org
Contact House and Senate leadership: @SpeakerPelosi and @SenSchumer. Tell them that it's unacceptable to bring EARN IT Act to a vote given the overwhelming concerns and opposition from human rights and LGBTQ+ organizations. Send them this letter: cdt.org/wp-content/upl…
Send quick thank you notes to the Senators who raised concerns about EARN IT Act. Yes, they should vote against it, but speaking up DOES make a difference with whether this bill moves forward.

Here they are:

@SenMikeLee
@CoryBooker
@SenAlexPadilla

Before #EARNITAct markup, a @SenateJudiciary Culture Wars kerfuffle

January: @MarshaBlackburn asked a black appellate nominee (Andre Mathis) about his "rap sheet" (actually 3 decade-old traffic tickets)

Today, @SenAlexPadilla complained about this... 🧵ballsandstrikes.org/nominations/an…
Blackburn was pissed that Biden nominated Mathis to an appeals court in Tennessee over the "blue slip" objections of both TN Republican Senators

Trump bypassed 17 Dem blue slips

So Blackburn focused on Mathis's "rap sheet," implying that getting 3 tickets made him a criminal
"RAP" means "Record of Arrests and Prosecutions"

a "RAP sheet" is a list of criminal charges

It's NOT getting three traffic tickets a decade ago

.@SenateJudiciary is marking up #EARNITAct, which claims to crack down on child sexual abuse material but will really jeopardize prosecutions. Forcing tech firms not to use strong encryption & to monitor users makes them state actors who need a warrant 🧵

judiciary.senate.gov/meetings/02/03…
#EARNITAct's sponsors say they've fixed the bill. They haven't. Making the "best practices" "voluntary" doesn't help. The 4th Amd./privacy problem has always been come from exposing tech companies to such vast liability that they *must* monitor what users say & abandon encryption
#EARNITAct was changed in 2020 to "fix" the liability it enables under federal law (by tying it to "actual knowledge", but it then does exactly the same thing through the back door: enabling states to enforce criminal & civil laws that turn on mere recklessness or negligence

hi @AOC @RashidaTlaib @AyannaPressley @IlhanMN @JamaalBowmanNY @CoriBush please help!

Human rights orgs & marginalized LGBTQ+ folks have been sounding the alarm about the EARN IT Act but we are being ignored by Democratic leadership

We need your voices!
The #EarnItAct has been condemned by nearly every major LGBTQ+ rights organization in the US including @HRC @glaad @NCLRights @LambdaLegal @TransEquality as well as orgs like @RedCanarySong @amnesty @hrw

See this letter freedomnetworkusa.org/app/uploads/20…
This bill is also opposed by security experts who have repeatedly explained how attacking strong end-to-end encryption that is used by millions of people will literally get people killed, particularly activists, marginalized folks, journalists, domestic violence survivors, etc

THREAD: The #EarnItAct is very simply about whether tech companies should be held responsible for their complicity in the sexual abuse & exploitation of children when they refuse to report or remove images of these crimes hosted on their platforms. 1/
The internet is infested with stomach-churning images of children who have been brutally assaulted & exploited, & who are haunted by a lifetime of pain after these photographs & videos are circulated online. 2/
Tech companies have long had ready access to low-cost, or even free tools to combat the scourge of child sexual abuse material, but have failed to act. 3/

Last night, sex workers in Oakland sent a clear message to @KamalaHarris on her home turf: her vote to advance the #EARNITAct was a betrayal.

The EARN IT Act is SESTA/FOSTA 2.0.
The good thing is that @KamalaHarris can join @Wyden in opposing this trainwreck of a bill. #NoEarnItAct

You, reading this, can tell your reps how you feel now at noearnitact.org
We are hearing that #EARNITAct sponsors may try to force the bill through the Senate this week. They are trying to be sneaky because this bill never was about exploited kids. It's about censorship and ending essential online freedoms. #Section230

When we said that the #EARNITAct is being pushed hard right now? @senrobportman just signed on as a co-sponsor, noting the WILD success of #SESTA #FOSTA - lets look at that incredible success, shall we?
First, if you want to read about tech/trafficking from a human rights perspective, can't recommend the Anti-#Trafficking Review more. Their last issue was entirely on tech, including #SESTA, but also other areas of labor/migration/surveillance antitraffickingreview.org/index.php/atrj…
Maybe the Senators backing these bills could send an intern to ya know... read up on this stuff before passed bad legislation... but I digress. So the success of #SESTA, shall we?

⚠️UPDATE on #EARNITAct⚠️

It has become part of a one-two punch to destroy the ability of the web to fight back, then end #e2ee.

The full force of the net must be unleashed to defend our rights: NoEarnItAct.org / Text EARNIT to 68788, msg+data rates may apply
Our freedom from government surveillance will disappear unless we take action.

We have to #SaveEncryption and stop the EARN IT Act and the LAED Act.

Some say the amended #EARNITAct is no longer a threat to encryption. This is FALSE.

The EARN IT Act is now the first bill of a one-two punch designed to destroy end to end encryption.
