Useful 🧵 on today’s #CJEU Dwyer judgment - a notorious murder in Ireland that was only solved because location data was routinely saved for 2 yrs in case police needed access in a criminal investigation. /1
This enabled the crime to be pinned on a previously unsuspected architect, whose professional movements over a long period corresponded with those of the incriminating phone. /2
I was an expert witness in the case so will not comment further on a judgment that largely follows #CJEU precedent, whatever you think of it (other approaches are available: see #ECtHR). /3

At Eur Court of Human Rights (ECtHR) for the #MH17 hearing on admissibility and jurisdiction. The cases of #Ukraine v #Russia and #Netherlands v Russia are joined and discussed together today. Things are heating up between UKR and RUS: now that’ll be fought out in court as well.

RUS starts with arguing ECtHR should reject cases because no extra-territorial jurisdiction: it occurred in UKR; RUS had no effective control over the area. RUS points to financial support to UKR and suggests that this instead is effective control by Western states there. #MH17

1. #CAS is a crucial player in sports governance, it whitewashes legally speaking the decisions of international SGBs. Once a CAS award confirmed a decision of an SGB, the latter gains in authority and becomes extremely difficult to challenge elsewhere (see #Pechstein odyssey).
2. #CAS is not an arbitral tribunal, I repeat #CAS is not an arbitral tribunal! As I have argued elsewhere (nomos-elibrary.de/10.5771/978374…), CAS jurisdiction in appeal cases cannot be grounded on consent, it needs post-consensual foundations (such as the famous ‘level playing field’).

2/M.S.S paved the way to temporarily stop returns of asylum-seekers from European members states to Greece due to the malfunctioning of its asylum system and the inadequate living conditions facing individuals.
3/The @COE_Execution should now assess if measures taken by Greece addressed the structural issues found by the Court in the areas of:
- asylum procedures
- living conditions in camps and facilities
- treatment of unaccompanied minors
- use and conditions of migration detention

Recent setbacks & successes: an #ECtHR ruling legitimised a push-back at the #Melilla border fence but on 6 Feb we held a large protest at the #Morocco - #Algeria border to commemorate dead & missing travellers. In late Feb, 8000 people marched in #Ceuta against racism.
Most of the distress calls #AlarmPhone received came from the #westernsahara route where our collaboration with the #Spanish Salvamento Marítimo was good. In the Strait of #Gibraltar or the #Alborán Sea it was more difficult: often cases were referred to the #Moroccan Navy.
