First, #EIADraft2020 is legally untenable. It does not conform to its parent Act, the Environment (Protection) Act 1986. Contrary to the aims of the EP Act, it reduces the *scope & stringency* of environmental impact assessments, threatening local ecologies and people. [2/7]
Second, worryingly, #EIA2020 allows the government to grant environmental clearances to projects that have *already commenced illegally without a clearance,* going against the very rationale of the EIA notification. [3/7]
Summarising some areas of concerns on #EIADraft2020.
1. Post facto Enviromental Clearance - This allows regularisation of projects started without prior EC on payment of fine.

2. Relaxation for mining projects : In 2012, the SC held in 'Deepak Kumar' case that mining projects of even less than 5 hectares require prior EC. Attempts to dilute this subsequently were stopped by NGT. As per #EIADraft2020, mining projects less than 5Ha are in B2 category.
3. This means, there is no need for EC. They only need to take what is called a "Prior Environment Permission" which is easily obtainable, without Environment Impact Assessment, Public Consultation and scrutiny by Expert Appraisal Committee.

India emits about 4.85 GT of Carbon every year. It absorbs less than 0.28 GT of carbon through its existing forest and tree cover. How can the Ministry claim it is assessing environmental impact if there is no public record of carbon emissions projects cleared by the ministry?
In the 2016 India committed itself to increasing its carbon sink by 2.5 to 3 GT of CO2 equivalent through additional forest and tree cover by 2030. The Government, however, has not even notified this commitment for every ministry to align to this goal.

அதற்கான ஆதாரத்தை கேட்டிருந்தார்.

1974 நீர் பாதுகாப்பு சட்டம் ,1981 காற்று மாசு சட்டம்..ஆகியவை முதலில் கொண்டுவரப்பட்டன ..1984 ஆம் ஆண்டு ஏற்பட்ட போபால் விஷ வாயு கசிவுக்கு பின்பு தான் 1986இல் சுற்றுசூழல் பாதிப்பு பாதிப்பு சட்டத்தை மத்திய அரசு அமல்படுத்தியது .
