Exactly how long of a reprieve does this "explanatory declaration" grant Hungary & Poland from being subject to #RuleOfLaw mechanism?

Nobody knows. Some lawyers saying 2 years. EU Justice Commissioner saying only a few months.
The (rather predictable) response to #EUBudget compromise from 🇭🇺: "Hungary and Poland claimed a historic victory in the #RuleOfLaw negotiations".

In reality, the mechanism has remained intact. Application may or may not be delayed up to 2 years, depending on legal developments. Image
Belgian PM @alexanderdecroo says an urgent procedure could be used to avoid delays in the ECJ ruling.

The courts are "impartial" he says. “I do not think that it is a victory of one over the other, this is just a good way going forward.”

#EUCO leaders have talked through the night on two contentious issues: sanctions against Turkey and raising the EU’s 2030 emissions reduction target.

On thé latter, we’re close to a deal but not quite there yet. Eastern countries want more money for the energy transition.
But they are still stuck on the 2030 climate target as Poland wields its veto, just as it did for the 2050 target.

Last time Poland was bypassed and the target was signed by all except Warsaw. Will they have to do that again now?
PM #Morawiecki says he’ll only drop his climate veto if #Poland can keep more profits from #EUETS emission trading, reportedly telling the other leaders he’ll lose his job if he returns to Warsaw without this concession (having caved on his #EUBudget veto threat last night).

EU prime ministers and presidents are about to start arriving here for the #EUCO summit.

Key thing to watch as they make their doorstep remarks: any sign of wavering on #Brexit? Any openness to changing the negotiating mandate red lines?

Hungary/Poland lift their veto on EU budget, after being reassured that new #RuleOfLaw mechanism won't be applied to them until a judgment of ECJ will define 'methodology' to be applied.

This is not only unprecedented, but also LEGALLY questionable THREAD #EUCO 1/ Image
The draft #EUCO Conclusions, a non-legally binding political declaration, de facto suspend application of #RuleOfLaw mechanism.

🇪🇺 Today’s #COREPER II has just started. EU Ambassadors will take important votes on the next #EUbudget. Among them are votes on
🔹the #EUbudget & recovery package,
🔹the conditionality mechanism and
🔹the own resources decision.

👉 EU Ambassadors confirmed the final compromise text with qualified majority.

This morning @EUCouncil agree on historic 3y spending to kickstart the economy (750Bn€, w/ 390Bn grants & 360Bn loans) + 7y #EUbudget to invest in the long term (1.074Bn€). Before @Europarl_EN decides on this deal, let's see what’s in it: the good, the bad and the ugly. #Thread
Good n°1: Good news: there is a deal, and we are in July. I personally did not expect them to find an agreement before the fall, so having a deal in mid-July is already a positive piece of news in itself.
Good n°2: The overall architecture has not changed. Yes, less money will be invested than what was originally proposed (more👇), but we still get a reasonably sized budget (1.074bn€ over next 7y) + significant input of fresh money (390Bn€ in grants) that is good for #recovery

Also wer die Geschichte vom Rabatt schreibt ohne gleichzeitig über die insgesamte Beitragssteigerung zu schreiben, hat echt was grundlegend falsch verstanden.

Spoiler: wir zahlen ca. fünfmal mehr ein als uns der neue Rabatt "erspart". #euco #eubudget
Gleichzeitig werden die Verteidigungsausgaben exorbitant verfünfzehnfacht, aber der Anpassungsfonds für die Klimakrise um 3/4 gestutzt. Verwaltungskosten steigen im Übrigen trotz aller großen Ankündigungen.
Das BMF rechnete selbst mit einer Steigerung des ö Beitrags auf Grund des neuen Vorschlags von 2900 auf 4400 Mio. Euro jährlich. Da kommt jetzt der Wiederaufbaufonds mit 1,5 Mio. pA oben drauf.

Big test now for the EU: preserving market confidence that it's got this and something will get through. The balance of grants vs loans matters less than showing that there's money available that can get where it needs to go.

Current discussions on the #EUbudget exemplify the EU's core problem. Instead of thinking about goals and what #EU citizens need from the Union, each Member State's executive looks at its own balance sheet, its net contribution, and what it pays in and receives. #IamEuropean
#EUbudget discussions should go the other way around. First, identify what the #EU should do for citizens, where it is needed, what it can bring. And only then work out how much this costs us all together. A discussion centred on 1% and 1.14% serves State budgets, not #citizens.
