Since you absolute savages seem to like my uhhhhh...
court reporting? free form legal street synopsis?

whatever it is.
I'll be doing it again today.
Follow along.

Since time is relative in the legal universe, folks, remember to hydrate before the shenanigans begin.
and for those asking, today it's a combination of Monkey Thunder, a Sativa heavy hybrid, and Platinum Valley, an incredibly cerebral strain.

However, it may have been that "what the hell are you smoking?" was rhetorical.

If so, I apologize.

So Eastman's "expert witness" Freid (Fried?) who is a CPA, will NOT have his "self published ebook" admitted as export testimony in his case.

Judge says "How is this dude an expert?...According to information you (Eastman's atty) gave court, he has no experience in vote audits"
Eastman's attorney is arguing he knows math because he's a licensed CPA with "40 years auditing experience"

Judge says NONE of that is in election auditing.
Eastman's attorney is trying reeeeeeeeaaaalll hard to get the CPA's "analysis" in.

Judge is not having it.
"the 40 years of experience has NOTHING to do with the analysis of raw voter data"

"but judge, it's numbers. he knows numbers."

Good luck Eastman, you're gonna need it.

Sidney Powell’s team cld not get Gohmert’s SCOTUS brief—asking Alito to stay certification of Biden’s win to allow briefing on Eastman’s BS legal theory—until 3:51 pm on Jan 6. A Republican Congressman tried earlier that day but failed. Is this when the breach was ordered? 1/ Image
2/ The screenshot in post 1 is from this article by Sidney Powell. archive.vn/2021.09.18-034

3/ Gohmert’s brief was based on Eastman’s legal theory that Pence had discretion to reject the real electors & count the fake ones and/or throw it back to the states. Even Eastman knew the theory wld fail on the merits. Image

This will be the formal live-tweeting of the @DrJohnEastman Privilege hearing with replies below. 111 documents at issue. Hearing begins with #Eastman lawyer trying to clean up issues that should be clear (i.e., was there attorney-client relationship with Trump)
#Eastman begins with argument that the 111 docs are all basically work product & the standard for wp waiver is higher than just bare communication - key case here is US v Sanmina, 968 F.3d 1107 scholar.google.com/scholar_case?c

After wp doctrine, now we're getting into crime/fraud exception, which #Eastman notes is why we're all here

#ClaremontInstitute planned using cops to overturn Trump’s election loss

They published a report in mid-October 2020 that gamed out a scenario where Trump would remain in office through an alliance between law enforcement and militant extremists

#MOG
rawstory.com/claremont-inst

The report prepared by #Eastman, who authored a memo laying out another strategy for keeping Trump in office, and former advisor #McFarland, #KevinRoberts, then-executive director of the Texas Public Policy Foundation, #JeffGiesea and right-wing blogger #CharlesHaywood
The report is an instruction manual for how Trump partisans at all levels of government — aided by citizen 'posses' of #ProudBoys and #OathKeepers — could, quite literally, round up opposition activists, KILL THEIR LEADERS, and install Trump for a second term in office

Wow #Eastman is in deep. He was so committed to his coup plot, he kept pressing Pence not to certify the election—even after the Capitol siege. And as the mob was hunting Pence, Eastman told Pence aide the riot was his own fault for not following his plan. washingtonpost.com/investigations

The depravity is something. Pence aide sent #Eastman an email during the riot telling him they were under siege, and Eastman responded by blaming Pence and *mocking* the attack, putting "siege" in quotes.

“The ‘siege’ is because YOU and your boss did not do what was necessary
"
Eastman's depraved response to Pence aide is reminiscent of Trump's depraved response to Kevin McCarthy, who reportedly called Trump during the insurrection, begging him to call off the mob. And Trump said "Well, Kevin, I guess they care more about the election than you do."

The headline here is John Eastman is backpedaling because he's losing and he was caught in still more lies in the National Review interview.
And Eastman's whole point is preposterous: he put "crazy" wrong theories in a legal memo from him to be distributed to others, without even noting that the arguments are weak or don't represent his own views? No respectable lawyer does that in giving legal advice.
And even now Eastman hedges, saying the issue of the VP's authority to unilaterally reject electoral votes is not "resolved." Absurd and dangerous.
