If they put on a case — the defense disclosed to the prosecution their first witness will be a paralegal from their firm.

They also told the government they plan to call a 2nd witness: Theranos board member Dr. Fabrizio Bonanni.

The gov't moved to exclude Bonanni's testimony.
The defense is arguing the relevance of Dr. Bonanni's testimony, who they said joined #Theranos in March 2016.

Bonanni will speak to the capabilities of the Minilab, which they pointed out rebuts an allegation the government made in the indictment, they told the judge.

Defense attorney John Cline is arguing with Prosecutor John Bostic about which portions of Parloff's interviews with Holmes can be played to the jury on cross examination.
“She needs to take the stand and testify," Bostic said, citing hearsay concerns over portions of Holmes' interview, the defense sought to admit.

Cline argued he could admit for Holmes' state of mind.

"She's not trying to deceive Parloff or the investors," Cline said.

Investor Alan Jay Eisenman will be the witness this morning. He is on cross and is expected to finish by EOD (1 p.m. PT)
Eisenman is back on the stand. Downey began by asking the investor if he recalled a quarterly meeting call he had with Holmes in March 2010.

Eisenman said he did not recall.
"I have a whole trail of notes over [several] years," Eisenman said about a potential IPO, evading Downey's question about whether or not Holmes mentioned an equity offering in that 3/2010 call.

Yesterday there was an hour-and-a-half convo between the parties regarding the scope of questions permissible to ask former Fortune writer Roger Parloff.

He could testify as early as this week, attys said.

Dr. Henry Kissinger's longtime lawyer Dan Mosley, who personally invested $6 million in Theranos after the former Secretary of State asked him to vet the company, is back on the stand Wednesday morning where he will likely complete his testimony.
In pretrial arguments, Judge Edward J. Davila said he will "very well likely" grant the defense's motion to exclude testimony from patient "B.B." who received purportedly inaccurate results from an assay not included in the government's indictment or bill of particulars.
"It sounds like the government was confused as to its assays," Defense attorney Katie Trefz told the court.

“This is the U.S. government, this is a criminal case, they should be held to a higher standard.”

Schenk pulled up the "Certification of designation of series c-2 preferred stock" and is going through it with Mosley.

Mosley is back on the stand, and Schenk is having him decipher some handwritten notes he took about #Theranos at an unspecified time.

His hand writing is worse than mine.
Schenk ran Mosley through a slide deck he received from #Theranos. He highlighted many of the statements we have seen from other slide decks in other investors' binders.

They touch on accuracy etc.
