OBTAINING EMAILS/TEXTS ABOUT YOUR CHILD. Emails and texts are NOT considered "student records" but parents CAN obtain them via PUBLIC records. I've created a little background fact sheet so you can understand why that is. The main issue is that FERPA says only records that are
identifiable and are MAINTAINED are student records. The courts have defined "maintained" as in a physical file. So, emails and texts (and Google docs communications, etc), unless they are printed and put in a physical file, are not considered "educational records." However,
they are PUBLIC RECORDS which you can get via a Public Records Act request. Remember to request ALL COMMUNICATIONS since the district staff also use things like Google Docs to communicate, as well as text messages. (You can even get text messages sent on personal cell phones!)

There are many concerns about #WESELPA (@UplandUnifiedSD, @AltaLomaSD, @CJUHSD and 6 other districts). Each of these Districts pay into the #WESELPA to support their special education students.

The link below is from the #Fiscal Crisis Management Team (#FCMAT), an independent
organization that was called in by Independent districts within #WESELPA because of lack of trust and transparency. This report was done in 2010 and the same issues still exist in 2020.

This report talks about the contingency fund (#Xpot)* that is used for legal fees, p29.
The report states that staff was skeptical if Xpot* was used for intended purposes, #Xpot may encourage undesirable practices, Xpot is not a source of funding, #SELPA members do not have a clear understanding. *the term Xpot is no longer used.

@UplandUnifiedSD hired investigator to do surveillance on parents attorney and private tutor for $2,573.56

Be aware of how @UplandUnifiedSD tax dollars are being spent. Invoices obtained detail how Matthew Burris of the law firm of Fagen, Friedman and Fulfrost,
who represent @UplandUnifiedSD , hired another company (Nationwide Legal) to do surveillance on the attorney and private tutor of a family in the district.

According to their website, Nationwide legal specializes in “undercover investigations”. The website states:
“Do you need a male or female investigator to go undercover to gather valuable information for your business, personal life, court judgments….Are you looking for information regarding someone’s secretive past?.... Hire a skilled Private Investigator to find the truth. ”
