I'm seeing a lot of people upset that the White House is once again going to transfer $7.2 billion of DOD funds to pay for the border wall. (first reported by the WaPo).

Why didn't Congress stop this?!? people are demanding. Well, it tried, and it couldn't muster the enough votes. Here's a quick thread tracing some of the history of how the administration is spending money for purposes other than Congress spelled out, and how Congress responded.
First, as this @lawfareblog piece explains, the declaration of a national emergency allows the WH to invoke 10 U.S.C. § 2808(a) as justification to repurpose DOD funds. So the first way to stop this from happening would be for Congress to vote to terminate the national emergency.

Senate Republican Leadership, @senatemajldr @JimInhofe @SenatorRisch, just wasted America's best opportunity to push for peace in #Yemen by eliminating a ban on US arms sales to Saudi Arabia & the UAE in #FY20NDAA, our National Defense Bill. #YemenCantWait 1/7

My #FY20NDAA puts military families first. By implementing the most substantial overhaul of the privatized military housing, we’re going to make sure military families never again have to worry about having a safe, habitable roof over their heads. Image
Thank you to @SenJackReed for fighting along with me to make sure our housing reform legislation was part of the final #FY20NDAA. He and I have worked together nonstop to see this through, and I’m proud we were able to deliver these results for our military families.
Lastly, I want to thank the brave military families who stood up and called out injustice and mistreatment. You deserve better – and with the #FY20NDAA, we’re taking steps to make it right. Learn more about what’s in our bill here: bit.ly/2RCNgli

I want to pay special tribute to the families and friends of the 7 Oklahomans who were lost that day: Brian Moss, Spc. Chin Sun Pak Wells, Jayesh Shah, Wayne Terrial Davis, David Harlow Rice, David Shelby Berry and Maj. Ron Milam. We mourn with you today. oklahoman.com/article/360329…
We must continue to provide a strong national defense that can deter and defeat the seen and unforeseen threats of tomorrow, that is fully engaged and fully funded to ensure another 9/11 does not happen.
