Fiqh & Fatwā

A true faqīh…

He was asked a fiqh question. He said —

1. If you’re seeking fatwa (‘ilm in context), then ask the people of your locality

2. If you’re seeking (‘ilm in itself, non-contextual), then the ruling is what Imām Abū Hanīfa has stated…
I bring attention to this because, the crux of #metafiqh is to distinguish between non-contextual and contextual rulings and to delinate the process of reaching contemporary codification. It’s a pioneering effort. May Allah grant highest tawfīq and avert all envious eyes…
May Allah bless the true fuqahā’ and grant us from their adab and ‘ilm and guide us through their deep understanding and keep us firm upon their way. آمين

Fiqh

“…if [religious matters] were [only based on] explicitly stated evidence, then you and the fuqahā’ would be equal.”

It means —

There is much more to sacred knowledge than transmission, and only those who put themselves on the same par as the fuqahā’ see it as such.
It’s ironic there’s any claim to nuance on social media. That’s why we abstain from religious discourse here & guide to proper methodology instead. Prophetic inheritors have a scholarly mind, not just a tongue of transmission. I’ve searched my whole life for them and continue…
If we render Religion a goal post that we draw near to us for a “victory”, we’ll win it for the ego, lose it for the soul. Dunya is delusion for it lulls us into thinking that it’s standards suffice for happiness. True believers know better. They know what happiness truly is…

[Thread] sur "ce qu'on nomme la Charia et son application au #Senegal,
#Fiqh, #droit_musulman, #Coran, #kebetu #seneweb

#manuscripts #Shii #PositiveLaw #fiqh for much of the middle period through the #Safavid period the main text for the introductory study of the law was al-Lumʿa al-Dimashqīya of the #FirstMartyr #ShahīdAwwal Shams al-Dīn Muḥammad Ibn Makkī al-Jizzīnī al-ʿĀmilī (d. 1384) 1/
#ShahīdAwwal famously wrote this work in prison in Damascus - and there has always been a sense that he may have had some links with the #Shii #Sarbadar rulers of Khurasan for whom he may have written it as a manual to implement alfeker.net/library.php?id… 2/ Image

As a follow-up to a thread on the #GunābādīNiʿmatullāhī order and #ShiiSufism some thoughts on Maʿṣūm ʿAlī Shāh (d. 1926) the famous 'historian' of Sufism 1/
His father Raḥmat ʿAlī Shāh (d. 1861) came at the end of a scholarly lineage of #Niʿmatullāhī Shaykhs: Muḥammad Jaʿfar Majdhūb ʿAlī Shāh (d. 1824), Zayn al-ʿĀbidīn Shīrvānī Mast ʿAlī Shāh (d. 1838), and Raḥmat ʿAlī Shāh himself all of whom had good relations at court2/
Majdhūb ʿAlī Shāh was closely linked to the traditional seminarian philosophers in Isfahan and Tehran and wrote a scholarly polemic against Henry Martyn (d. 1812) called Mirʾāt al-ḥaqq ar.rasekhoon.net/mashahir/show/…مجذوب-علي-شاه 2a/
