HISTORY:

4/18/17: We sued Idaho over their categorical refusal to allow transgender people to correct the gender marker on their birth certificates.

3/5/18: We won! Court orders officials to begin allowing Idahoan-born trans people to do so beginning 4/6/18.
3/20/20: @GovernorLittle signs into law #HB509, banning transgender people from changing the gender marker on their birth certificates.

#BREAKING: Decision just dropped in our case fighting for transgender Idahoans' right to obtain accurate birth certificates.

Court warned Idaho state officials that its 2018 permanent injunction blocking their former anti-trans policy continues to apply.

While the court did not address whether #HB509 requires the Idaho Department of Health and Welfare to reinstate such a ban, it made clear that, if officials took steps to reinstate such a ban—even if directed by state law—they would be in violation of the injunction.
The court has confirmed that its injunction continues to apply, in full force and effect, and it has now expressly cautioned that #HB509 does not whatsoever absolve state officials from their obligation to comply with the federal injunction.

🏛️IN COURT: This morning we're in the United States District Court for the District of Idaho defending transgender Idahoans' right to correct and hold accurate identity documents.
Our Counsel Peter Renn is up: "Plaintiffs are asking this court to confirm that it meant what it said in 2018."

In 2018, we won an injunction blocking Idaho's categorical ban on trans people correcting birth certificate gender markers. This year, ID passed a law in opposition.
The law passed was #HB509, which bars transgender Idahoans from correcting their birth certificate gender markers.

Apparently passing just one anti-transgender bill out of the Idaho legislature wasn't enough today.

They approved a second this evening barring #transgender Idahoans from correcting their birth certificates—in direct violation of a court order from 2018.

The bill approved by the Idaho Senate (after approval from the state House) would ban #transgender people from changing the sex listed on their birth certificates.
