Here’s what I didn’t get to say today at the House Education & Labor hearing on the new Title IX rule and gender bias in the Trump administration. The administration is arguing that this rule is justified by previous Supreme Court decisions.

In Davis v. Monroe, SCOTUS created a specific Title IX standard for students to bring lawsuits against their schools for failing to address sexual harassment and assault by other students. @NWLC knows this decision well — after all, we brought that landmark case.
While Betsy DeVos & the GOP witness today argued that the Dept of Education’s new Title IX rule is consistent with the Davis standard, the truth is that the Department threw out a legal standard it had been using for almost 20 years for schools’ responses to sexual harassment.

Since DeVos' rescinded the 60 day recommended timeline in Title IX cases some survivors' cases have taken 200+ days. Some survivors have told us their school failed to investigate their case for over a year.

Today is the 48th anniversary of Title IX!

48 years ago, we received the right to equal educational opportunities regardless of gender thanks to Title IX and the tireless work of Bernice “Bunny” Sadler, Rep. Edith Green, and Rep. Patsy Mink.
But almost 50 years later, the rights afforded under Title IX are still just rights on paper and not in practice for many of our transgender siblings.

We've seen wins in federal courts for trans workforce, but trans students are still fighting for their rights in schools.
As survivors, our fight for Title IX must include the rights of trans students. That's why our #HandsOffIX petition demands schools uphold the rights of trans students outlined in previous guidance.

The Department is looking to override state laws that mandate trans-inclusive school policies. DeVos is claiming Title IX requires anti-trans discrimination––it does not.

Many federal courts agree that Title IX’s bar on sex discrimination prohibits anti-trans discrimination.
Betsy DeVos has continued to use her position to further discrimination in education. That is the exact OPPOSITE of what she is supposed to be doing as the Secretary of Education.

DeVos' new Title IX rule would require schools to dismiss most reports of violence that occur off- campus, and all that occur outside of the U.S.

Here's why that matters:
Only about 8% of all sexual assaults involving middle school, high school and college students occur on school property.

That means DeVos’ Title IX rule would require schools to dismiss around 92% of all reports of assault.
DeVos' #TitleIX rule would mean students that are assaulted off-campus will either have to share a classroom with their rapist or drop out of the class.

Title IX is meant to protect survivors' right to an education. Instead, this rule would push survivors out of school.

This week @bidenfoundation submitted a comment to the Department of Education about proposed changes to #TitleIX guidance.

These new rules would endanger students and make it harder for survivors of sexual assault to seek justice.
Students and survivors are making their voices heard. Grassroots organizers are working to make sure these guidelines are never put into effect.

It’s important that we not create confusion about the reality of sexual violence that students experience and the rules that DeVos has proposed. Thread.
1) The violence that students face in schools has long been kept in the shadows. Few people come forward because they know they are unlikely to be believed. Or that their schools will treat the violence they endure as unimportant. The DeVos proposed rules will make this worse.
2)All survivors face deep skepticism. That is our culture at its worse and unfortunately our laws and processes have often reflected that idea.

How is she going about it? First, she’s trying to narrow the definition of sexual harassment so severely that students would have to suffer repeated and worsening harassment before anyone in their school is required to help them.
