Former Additional Solicitor General Darius Khambata arguing for one of the petitioners - The new amended Rules have a chilling effect on the freedom of speech. The Regulations are so vague that it can haul up anyone for publishing anything online.

#BombayHighCourt #ITAct
Khambata - Ex facie the new rules are ultra vires of the IT Act which seeks to regulate publishing on electronic media. Original IT Act didnt purport to regulate content.

The Govt. of India has responded to #PegasusProject inquiries on the alleged hacking, mentioning that any interception, monitoring or decryption carried out is done as per the due process of law.

However, this response is massively insufficient.

The IT Act 2000 is what governs today's #DigitalIndia. However, when it comes to 2021's tech realities, this Act is woefully inadequate and needs to be revised ASAP!

Our digital governance laws + frameworks must protect citizens' fundamental rights 👇🏾

In Jan 2021, we received reports of plans by the government to update this Act. We followed up and were informed that @GoI_MeitY's discussions with "relevant stakeholders" have already begun. But it's not just the provisions that need an overhaul, it's the complete framework.

We had filed an #RTI on 29 June 2020 requesting @GoI_MeitY to tell us the number of #websites that had been #blocked between 29 June 2019 and 29 June 2020.
The request was denied by the ministry citing Section 8(1) (a) of the #RITact as well as #Section69A of the #ITact. Image
However, when @RavneetBittu asked @GoI_MeitY about actions taken by the Gov. against #socialmedia platforms like #Facebook & #Instagram used to incite violence & hatred in society. The data on banned websites was shared along with the response.

We filed an appeal which was also denied. We believe that information such as this which directly impacts our fundamental right to Free speech and expression should be made available to the public.
