The top court had earlier expressed an inclination to close the proceedings in Supreme Court and transfer the amount to Kerala High Court so that it decides on the distribution and investment of amount after parties appear in person before the High Court

Earlier in 2016, SC had allowed one of the sergeants- Salvatore Girone to leave India after the NDA government gave a "no objection" report.
A brief about the case- The incident was reported on February 12, 2012 when the two Italian Marines- Sergeants Massimiliano Latorre and Salvatore Girone allegedly opened fire on an Indian boat-St. Antony killing two Indian fishermen from Kerala on board.
The Marines were then arrested by the Kerala Police and the case was later transferred to the National Investigation Agency (NIA).

BIG SETBACK for India in #ItalianMarines case. The Permanent Court of Arbitration at The Hague has given its decision saying that the Italian marines - Massimiliano Latorre & Salvatore Girone will not be tried in India. Italy has been asked to begin criminal charges against them.
India has been arguing from day one that Italian marines should be tried in India as they were in Indian waters when they shot two fishermen off the Kerala coast on February 15, 2012. @NIA_India had even readied a chargesheet against them.
And remember, all those claiming it to be a victory - “compensation” was never our primary argument. Our argument was that they have committed a murder and will be tried in India. Crores have been spent in fighting this case.
