A lot of folks in my TL are busily badmouthing the #JCPA, the legislation stalled in Congress that would force Google and FB to pay news orgs.

Australia has a similar system, called the Media Bargaining Code. I spent a few months there researching it and spoke to more than 20 news managers, at companies ranging from News Corp to the Guardian to small weeklies.

Most of them praised the Code for enabling them to expand staff or avoid layoffs. I checked in with a few of them last month, and they hadn't budged. They want it to continue.

Instead of holding big tech accountable by bringing #AICOA and #OAMA to a vote as @SenSchumer promised, we are hearing that he’s looking to put a handout to Murdoch, Alden Capital, and Gannett in the National Defense Authorization Act. Why you should be outraged, a thread.
The #JCPA is a pro-monopoly bill, allowing news publishers to form a cartel and demand payment for any links to their content. It’s must-carry, and must-pay, no matter how extreme the content. That's why 20+ civil society and library groups opposed.

2/ The first notable change to #JCPA actually happened the evening before the last markup. Recall that the bill allows publishers to join together to negotiate the terms and conditions by which platforms "access" their content. But "access" was originally left undefined.
3/ That was a problem, as it could have amounted to imposed must-carry obligations on platforms. But last week's manager's amendment inserted a definition of "access" -- "acquiring, crawling, or indexing content."
The answer is no, they won't. We need rules to stop targeted ads, and lots of antitrust law to break up big tech. This is one piece. And in Australia, the #JCPA-like law forced big tech to bargain fairly with the news and now journalist there is flourishing.
What is actually wild is how @mattfwood and his colleagues are weighing in on a bill about advertising when they have literally no idea how any of these markets work, and simply oppose for-profit news on principle.
And look, I don't mind those who oppose for-profit news and wish that America only had a public interest news ecosystem. I disagree with that premise. But if that's what you think, don't attack a bill that will redress advertising bargaining imbalances under false pretenses.

Ranking Member @SenMikeLee notes that the news crisis is the result of multiple, complex factors - and that they can't be solved by accepting a cartel, or changing laws to encourage them. Further, the largest news outlets would likely be the greatest beneficiaries of #JCPA

A few things to keep in mind as we head into this:
