1/ Thread (8) Young Lawyers who want to learn Criminal Law without help of any guide or mentor, may consider following points.
2/
1) Criminal law is a "Tacit Knowledge" (Knowledge that is learned by doing a task. Just like learning to ride on a bicycle. Here the whole body learns the skill when a job is actually being done.)
3/
2) To learn from a case, you must have access to some actual record of a criminal case.

1/ (7) Young lawyers often feel stuck in their career. They may try following exercise.

This exercise is called "20 Sentence Completion Exercise"
2/ Write, "I feel stuck in my life because ........ ".

Then complete this sentence 20 times. This will take out all worries from your mind and will put them on paper where you can see them.
3/ Then write, "I feel unstuck because .....".

Now, complete this sentence 20 times.

Here are some examples which have guided me :

Crimes happen in morning.
Crimes happen in Afternoon.
Crimes happen in evening..
Crimes happen during nights.
2/ Rich people commit crimes.
Poor people commit crimes.
Middle class people commit crimes.

Crimes happen in posh colonies.
Crimes happen in slums.
3/ Crimes happen in winter.
Crimes happen in summer.
Crimes happen in monsoon.

In criminal law you need to master only three laws.

In criminal law you need to read judgements on only three laws.

1/ (5)Young lawyers may find it helpful to keep a "Chronicle of Mistakes".

In young age, we are bound to make mistakes. After a hearing is over, we have lots of second thoughts on what we could have done differently to win the case.
2/ But by then, the bus has left. We feel sorry and guilty.

Following point can be remembered to reduce stress of discovering our own mistakes.
3/ "It is okay to be wrong. It is okay to commit mistakes. I showed up and I tried. And that is what it matters. "

It helps to keep a Chronicle of mistakes or a Learning Journal, to record what we could have done differently.

1/ (4)Young lawyers need to be clear about their fee policies.

I hear lots of juniors who complain that clients exploit them and pay them very low fees.

Following point can be remembered to reduce stress of being paid low fees.
2/ "Fee is not always in cash. It can also be rewards of other kinds".

Since 1982, my fee policy is :

"Whatever you can pay. You should be comfortable. And I should also be comfortable. You should not expect me to spend from my own pocket".
3/ My definition of "My being Comfortable" kept changing upward as my clients base grew.

Let me know if this suggestion is helpful and practical.

Thread (1 to 13) "Sir, how to write judgements? I am preparing for #judiciary exams" asked a final year law student.

1/ I have no idea whatsoever about how judiciary exams are being conducted and what types of judgements they want candidates to write in exam.
2/ But this post can give you my perspectives on judgement writing.

First, in your mind, replace word "Judgement" with word "Opinion".
3/ A trial court's Judgement is only a Trial Court Judge's written opinion about case before him.

Thread (1 to 8 ) 1/ A liftman in my chamber building recently committed suicide. We are taught in colleges that Law is considered science of social engineering.

Then can we explain position of law relating to suicide of this liftman ?
2/ He was in his 40th year. He used to salute me everytime I enter and leave lawyers chambers. Like all other lawyers, I also used to give him tips. But then nothing more.
3/ When I heard about his sudden suicide, I first time realised that he too was a human being with emotions. So far I used to see him only as a liftman.

8) The process is mostly about #s and mindgames, unfortunately. Don't do things just because others are doing them. Don't forget why you went to law school. Don't base your happiness and self-worth on what strangers think of your stats.

An anecdote to show how arbitrary/archaic OCIs can be: One of my interviews consisted 100% of pro sports talk. It was so novel that I was conversant in an area that normally attracts *ahem* other demographics. Zero mention of my quals, but I made it to the next round. LOL.

1/? #lawtwitter Applications for #OCIs and the #articlingrecruit are coming up! Having done OCIs recentlyish, I have the following tips that might be helpful:
1) Trim the # of words in your cover letter by cutting superfluous adjectives/adverbs. A wall of text is intimidating.
2/?

2) Have an attention-grabbing and creative "elevator pitch" right at the outset of your letter, just so the reader gets an idea of who you are and what makes you different from hundreds of other applicants.

3/?

3) Express your genuine interests and try to connect them with the firm/org's specialties, but avoid construing yourself as closed off to less flashy areas of law because students are often asked to do an array of things from various partners.

2/ It was around 1991. I was preparing for AOR Supreme Court Exam. It was my first attempt at this exam. I had rented one room at about 200 feet distance away from my house.

In this room, I used to go to read for about 8 hours a day.

I used to study alone.
3/ (In 1975 around, I had picked up a quote from a book, "Isolation and Discipline are essential for progress of an Individual". I used to follow this concept wherever I can.)

Alas! Alas ! Alas ! If someone had told me this when I was young. I wish someone had told me then that โ€œThe Road of Goals is filled with pebbles of gold.โ€

All I needed to do was to lift pebbles and to finish goals mentioned under the pebbles.

#motivation
2/ To understand a cryptic section, we #lawyers and #judges, read a sentence twice, thrice or till we understand meaning of each word.

If you will read earlier tweet in this thread again, you may find that the pebbles on the road to goals are very heavy.

3/ As I came out from the college, I saw that my friends were focusing on picking up pebbles of gold on the road of goals. I however kept gazing at stars, kept reading books and became an idealist. I did not gave much importance to pebbles.

Thread : Some Reasons on why Anticipatory Bail, even without copy of FIR, ought to be granted to those who fear arrest for some social media post, posted or shared by them.

1) It is possible for courts to grant anticipatory bail to any law abiding person under Sec.438 of CrPC
2) The meaning of Anticipatory bail is simply this, the police should not arrest, but should get some personal bond from accused that he/she will co-operate with investigation.
3/ The grant of an anticipatory bail order, instantly frees the accused from fear arrest and torture by police of different States. It frees him/her from fears of custodial deaths or ill treatment in police station.

Thread : Four questions that may predict success of lawyer.

1/ Suppose you do have a abilty to read a law report and to make notes from that.

But do you also have ability to do the same when heat is 47 C and when there is no air conditioner?

#lawyers #lawstudents
2/ Do you have that abilty even when you are very much tired and feeling very sleepy ?

You may have ability to read any law report when you are required to do so for a case. But suppose, in your free time you are sitting in a court's law library,
3/ do you feel like opening any law report randomly and to start reading it randomly?

Suppose you have come to court but you have no case today. Do you feel like going and sitting in court of a most boring and most rude judge, a judge who keeps insulting lawyers one by one?

Thread : About double lives of Public Personalities and some methods to see what is hidden from public eyes.

1) If you become a public person, you may also have to start living a double life.

A public person has to manage perceptions of public.

#lawyers #lawstudents
2/ The public perceptions of a public personality is formed by the way he is seen in public, the way he speaks when he is public, what he is seen "writing for public viewing". This is all about managing optics. Now professional services of Perceptions Managers have also come up.
3/ This automatically means that a Public Person must hide that which is distasteful to public eyes and he should display only that which is suitable for public. This creates a double personalities within one individual.

Thread to remove many misunderstanding in mind of people about Law of Anticipatory Bail.

1) This is an easiest law.

And yet when a person hears that police has registered FIR and may call him to police station, he becomes very very much frightened.
2/ If he learns that in FIR his aged parents are also named, his panic increases.

If the charges in FIR involve more than 7 years, 10 years or life imprisonment, his fears multiply.
3/ If he is debtor and if Creditor has filed FIR, his fear increases. He fears that police will call him to police station and will force him to sign a settlement and will force him to give post dated cheques.

Thread about how Judges examine a document when a doubt is expressed about genuineness of that document.

1/ The question was about genuineness of a Will.

The man claimed "He was servant of the deceased. All his relatives had left him in his old age.
#lawyers #lawstudents
2/ He was looking after all court cases between deceased and his sons. Being pleased with his service, the old man, before dying, signed one page typed will, in which one property was given to him."

There was doubt about genuineness of this Will.

#lawyers
3/ Judge examined the Will like a Detective.

It was possible that this man may have obtained signature of old man for purpose filing some case and then he may have misused this paper for making Will in his favour.

Judge carefully looked at Will.

Thread "How to argue in court" - an easy to understand explanation to day to day Court Language.

b) "Defendant has cheated me." This is again, your opinion. This is not a Statement for purpose of argument.

c) "Defendant cheated me of 50 lakh rupees by giving promise of giving a flat". This can do. The Judge

Judge can then ask you, "Why do you say so? What is your basis for saying so?"

Now here you are supposed to answer with some evidence (documents or other things) from which it is obvious that you might be speaking truth.

Thread on "Citing Reportable and Unreportable Decisions of Superior Courts after explosion of Internet Law Reporting Software which give a unique citation reference to each judgement."

1) There was a time when lawyers used to cite SCR a govt publication in arguments.

#lawyers
2/ Then came a period when lawyers begin to cite SCC (And AIR) a private publication in arguments in courts.

Then many other publications came, like Judgement Today, SCALE, and several other weekly and daily reports came and they used to be cited..

Then internet came.
#lawyers
3/ After internet came, many software's like Manupatra etc came.

Lawyers begin to take print outs and the print outs were cited as judgements.

Many times, these print outs used to print name of lawyer who is licensed to use this law software.

Thread on need for lawyers and lawstudents to participate in public debates

Thread on "How NOT to open arguments in courts?"

1) These are my personal views. There are no hard and fast rules.

Every judge can react differently even if the opening statement of an argument is same.

Use your own discretion, experience and wisdom.
#lawstudents #law
2) Do not open arguments by saying that "This is a legal aid matter".

This irks most judges. You are indirectly saying to judge that 'I am obliging this poor person by taking this case, kindly be sympathetic to this litigant*.

Judge may be already knowing that this was a
3/ legal aid case. I have found that judges do not like these kind of opening lines.

Also don't begin by saying that "On last date, in this case such and such Senior Advocate had appeared and.... "

Judges do not like to be influenced in this way.

For Law Students and lawyers : Scope of Pillory Punishments

1/ In middle ages, a wooden plate was fixed around neck and hands of a convict, in such a that he can look like a walking banner. The hands were so fixed in wooden plate that he cannot eat or drink with his own hands.
2/ Then the convict was allowed to move in the town with wooden plate in his neck and hands.

This had dettent effact on people and there used to be less crime (Perhaps).

There are however provisions that

In present times, such punishments are not prescribed in law
3/ That certain crimes can be allowed to be compromised only with permission of Judge only.

This gives some powers to invent some new types of punishments to a Judge..

It was in news some years ago, that a political person was forgiven by judge only if he filed an undertaking

A thread for law students and young lawyers.

1. The real life is full of deception.

All cases of deceptions, cheating come to court.

You will also see human greed and how it grows up within close family members.

You will also see criminality, lust and other vices in cases
2/ In cases, you will see how facts are selected and reordered or presented in such a way that White looks Black and, Black looks White. Innocent can be portrayed as guilty and guilty can be portrayed as Innocent.

You will see lot of misery in litigants.

You will also see
3/ how judges and lawyers treat litigants.

And you will also see that there is nothing much you can do about anything..

At such time, read some books on history of evolvement of law.

You may find that we are far better than our past versions.

We are just pawns in the game
