Absolutism and #MayaForstaterCase2019

Accusations are admissions

The Forstater J’ment, in my view, misunderstands how sex, gender reassignment and gender recognition interact under UK legislation.
It ignores that laws governing legal sex change are nuanced and provide many exceptions which allow the state to see past legal sex change to original biological sex.

Instead it takes an absolutist interpretation of legal sex change.
Failing to recognise gender reassignment and legal sex recognition each interact differently with women’s rights.

Failing to explore the core conflict with which MF’s belief that sex matters with regards to women’s rights and impending changes to legal sex recognition engages.

I'm at the Employment Tribunal this morning to watch closing submissions for the #MayaForstaterCase2019. It's a particularly interesting case on whether a) gender critical beliefs and / or b) a belief in innate gender identity are protected philosophical beliefs.
Does there have to be a belief in innate gender identity in order for absence of belief to be protected? Possibly not, say the judge and counsel for the Respondent (employer)
Respondent kicks off with the assertion that MF's beliefs fail on Grainger 5: that they are incompatible with human dignity.

Good morning from a Central London Employment Tribunal. On application by RC, J confirms it’s OK to live tweet from the tribunal.
#MayaForstaterCase2019 today we will hear from the claimant’s witness, Kristina Harrison, and probably from the two respondents witnesses.
See my pinned tweet for background. Maya Forstater lost her job for tweeting about the conflict between gender ideology in public policy, and women’s sex-based rights. She is claiming discrimination on the basis of belief and sex.
