Hearing to resume at 10AM because Whitmore didn't get the lawyers' written arguments, emailed to the LTB. This issue constantly comes up since the LTB moved online. But the LTB's measure of success is not how fairly its hearings run, but how many evictions it can push through

The LTB is functioning as an eviction factory. I sat through a day of covid-related hearings yesterday. I was there to serve as a witness in support of the #EastYork50, who have brilliant legal & community backing

But for others, it was a nightmare...
The hearings are chaired by adjudicators who not all thoughtful or even necessarily fair, so tenants are at the mercy of the draw. Some are better (kinder, more willing to listen to tenants’ reasons for their inability to pay arrears) than others.

Some are downright cruel...
In one case yesterday, documented by @Peoples_Defence, a tenant was pressured into signing a repayment plan that he clearly didn’t understand. When a lawyer there for another matter offered to help him, the chair kicked the lawyer off the call instead of agreeing to the help...

Do you have an eviction hearing date?

If you don't show up to your hearing, the LTB will evict you in your absence. You can't ignore an eviction but you can fight it.

Call your legal clinic and ask them to represent you at the hearing.

Some legal clinics have refused to represent tenants who won’t sign dangerous repayment plans. This is not OK. If they refuse, ask for a letter confirming their denial of service.

At the hearing a tenant can tell their side of the story. The LTB has the power to deny the landlord’s eviction case or to give the tenant time to repay the rent owing.

You will be given a minimum of 11 days but tenants can ask for more time to repay.

🏡 Just over a year ago, the government pledged to end section 21 'No Fault' evictions for good. Under this callous legislation, landlords do not need to provide a single reason for denying tenants a roof over their head. Image
Now, with the ongoing public health crisis plunging renters into yet more uncertainty and our economy in recession, it is more imperative than ever that the government enacts this broken promise.
But with the government lifting its temporary 'ban' on evictions on Monday, and a quarter of a million renters facing homelessness, the reality of the situation couldn't be more opposed to their empty words.
