👇👇👇 Follow this thread for updates on @jpwarren's legal battle testing the secrecy around key #robodebt documents - being heard at the AAT now. Justin’s case forms the second in the Grata FOI Project and is being argued by Tom Brennan SC and @WeFightForFair #RightToKnow.
The issues at play are centred around whether or not Human Services unlawfully applied the #FOI ‘cabinet in confidence’, ‘deliberative process’ exemptions and the crucial public interest test.
Remember, the Information Commissioner has already found in @jpwarren’s favour and said the documents should be released to him. That decision is being appealed today by Human Services.

. @TheAusInstitute highlights a few NFP examples including the costs of managing an abandoned oil rig formerly owned by Woodside; money for the controversial Inland Rail project and expenditure relating to Australia’s Export Finance and Insurance Corporation. All are secret.
There may be valid reasons for some budget details to be kept confidential, but NFP is resorted to with ever greater frequency. It would be a good thing if @ANAO_Australia were to conduct an audit of NFP decisions. But, surprise, surprise, the Auditor’s budget has been cut.

2. The Court decided the letters were Commonwealth records under the Archives Act, because they were the property of the Cth, namely the official establishment of the Governor-General & ordered that Archives reconsider Prof Hocking’s requests for access to the palace letters.
3. HCA held “with respect to the majority in the Full Court, we cannot see how the correspondence could appropriately be described, however "loosely", as "private or personal records of the Governor-General" even allowing for ambiguity of the description of "private or personal"

I see many journalists blaming punters or treating them with disdain for not supporting them, maybe look at why? abc.net.au/news/2011-08-3…
We really do need journalists. The average person doesn't have same access to find out what Government is doing.

Journalists need support of people when under siege from a government that does not want any accountability or transparency and makes their job impossible to do.
Yelling at punters for not supporting them or not caring about their #RightToKnow or #FreedomOfThePress campaigns just increases the amount of people who have disdain for the profession and worse, increases the lack of trust.

Thread: off the back of the #righttoknow campaign I’d like to spill some tea about how utterly broken Australia’s freedom of information laws are by using some examples I’ve encountered in my FOI work around My Health Record, the amyl ban & sniffer dogs in Vic
Example 1: the ADHA (agency in charge of MHR) collected data on everyone in the country. Exactly what kind/how much? Collected how? The relevant legislation at the time had about two sentences authorising the ADHA to do this and it was *extremely vague*
Over several months I sent in numerous requests to the ADHA media and FOI teams about how this collection operated. They alternately told me that the request was unreasonable bc it identified hundreds of documents but also because no such documents existed
