New #safebanking news: Sen @SteveDaines told me he is open to adding the HOPE Act as part of “safe plus” legislation that could be included in an end of the year package.

HOPE is the @RepDaveJoyce/@AOC bill that gives states $$ to expunge cannabis-related records.
“We're open to some additions to [SAFE]. I think the HOPE Act is one,” Daines said. “But if it gets bigger than that, I think we're gonna have a problem.”
Daines also told me Monday night that he had a bipartisan meeting with Schumer planned for Tuesday to discuss the path forward for SAFE.

🧵I spoke with @repblumenauer yesterday afternoon about the conference committee and chances for #SAFEBanking in COMPETES. Here are a couple things he said:
About @PattyMurray making the weed banking bill a priority: “having her — as a member of the leadership — making such an impassioned pitch, I think is significant.”
If he thinks adding social equity or crim justice provisions to SAFE is feasible: “I want this to pass. To somehow allow people to continue dying because they're trying to link something they haven't been able to do after years, I think it's really unfortunate. And it's unfair.”

Trade groups are shifting their rhetoric a little on #SAFEBanking in the wake of Schumer and Booker pointedly prioritizing decrim legislation, noting here that it could "put wind in the sails" of broader decrim — which is a strategy some advocates like @NORML have embraced.
The other strategy, embraced by Schumer/Booker and progressive groups like DPA, ACLU, CAP and more, is that passing banking would satisfy many republicans and big groups like ABA, who would then not push for or even be willing to come to a compromise on broad decrim.
Part of the background is that even advocacy groups are settling into the belief that decrim will not happen in this Congress. Here a 3+ year timeline is put on broad reform. Other advocates liked/retweeted this.

BUT a separate measure on research on the benefits of psychedelics for active duty military members was blocked.

The email also references language added to the HEROES Act -- the coronavirus bill the House passed in May -- which would make banking services more accessible for the cannabis industry. At the time it was billed as a public health issue b/c it would end cash transactions.
Even back in May/June, Republicans took shots at House Dems over including the #SAFEBanking Act in the HEROES covid bill. Even minority leader Kevin McCarthy (R-Calif) who voted for the banking bill in the House, said it didn't belong in the HEROES bill.

Good morning! The House is voting on a slew of appropriations bills all at once (it's called a minibus).

It include protections for::
-medical marijuana markets
-rec marijuana markets (amendment, passed yesterday)

I asked banking reps about the approps protections. They said it is temporary and won't ensure banks keep their FDIC insurance, so it won't help banks as much as the #SAFEBanking Act. In today's #morningcannabis: Image
More breakdown:

The medical #cannabis market protection has been signed into law since 2014. That is likely in the bag, and is expected stay in the bill in the Senate.

The rec protections were removed by the Senate last year, and *probably* will be removed again this year.

Things are looking dim for #cannabis banking. I talked to @MikeCrapo yesterday and he said he has not talked to anyone about it being included in the Senate’s next covid aid bill. @SenCoryGardner also told me he wasn’t sure this is the best vehicle for it. Image
If banking isn’t added to covid aid, that greatly reduces the chances of it passing this year. Crapo and Gardner both said they still want to get it done, but they’ve been saying that since last fall. With election season approaching, there aren’t many days left for legislating.
It’s still possible that the watered-down appropriations language the House is currently considering could move through both chambers, but it leaves out a lot of the protections against money laundering, etc. that Crapo wants. So that could kill it too.

Word is that a ban on the use of no-knock warrants in drug enforcement situations will be part of the bill.
