Opening statement by GOP ranking member @RepGuthrie; needless to say he's gushing with praise for Verma. As I explained yesterday, the "4% drop in premiums" for 2020 is a) misleading and b) is basically just a correction of carriers overestimating costs in 2017 & 2018.

⚠️⚠️⚠️ ADVANCE WARNING: Long wonky MLR rebate thread ahead! All 50 states + DC!
One of the provisions of the #ACA is the “Medical Loss Ratio” provision, which requires health insurance carriers to spend a minimum of 80% or 85% of their premium revenue on actual healthcare/medical claims. It’s 80% for the Individual & Sm. Group markets, 85% for Lg. Group. 1/
Simple version: If an insurance carrier spends *less* than 80% (85%) on medical claims, weighted over a 3-year average, they have to *pay back* the excess to the policyholders.

So, if they bring in $100M in premiums & only pay out $75M in claims, they have to rebate $5M. 2/

📣 THREAD: Oral arguments on the insane #TexasFoldEm #ACA case will happen on Tuesday before a 3-judge panel for the 5th Circuit Court of Appeals.
One judge is a Jimmy Carter appointee.
One is a George W. Bush appointee.
One is a Donald Trump appointee.

As @mattbc just noted, while a HUGE social media presence to #SaveTheACA is expected (as well as real world protests/rallies, etc), the sad truth is that there's very little which can be done to influence the 5th Circuit panels' decision. They're lifetime judicial appointees. 2/
As he also pointed out, while the *hearing* will happen on Tuesday, they likely won't announce their *decision* on the case for several weeks or even months...and the odds are that their decision will then be appealed to the U.S. Supreme Court regardless of how they rule. 3/

As I keep pointing out (and as @RonBrownstein JUST WROTE ABOUT a few days ago), while it’s fine to discuss & debate #MFA vs #Med4America, etc, THE #ACA IS STILL UNDER ATTACK. MFA/etc won’t happen until 2022 at the earliest. The ACA is under attack NOW.

REMINDER: If the entire ACA were to be repealed:
—16 million people would lose Medicaid
—9 million people would lose subsidized exchange coverage
—850,000 would lose BHP coverage in MN & NY
...and that’s just for starters.

⚠️ GRAPHICS-HEAVY THREAD: Next week, the #TexasFoldEm lawsuit brought by 20 Republican Attorneys General against the #ACA goes to court. The Trump Administration is refusing to defend against it even though it EVERY legal expert says it’s a pile of steaming garbage. 1/
2/ If the #TexasFoldEm plaintiffs succeed, federal protections for those w/#PreExistingConditions would be gone. Not just on the individual market…people w/EMPLOYER coverage would be at risk as well, especially since most people are out of a job at least once in their lives.
3/ Here’s a reminder of the idiotic “argument” the #TexasFoldEm plaintiffs are using:
1. SCOTUS ruled the #ACA mandate is only Constitutional because it’s a tax.
2. The GOP repealed the mandate tax.
3. Therefore, they get to repeal the rest of the #ACA as well.

THREAD: For those who still don’t understand how important the #ACA #TexasFoldEm case is (along #StopKavanaugh), here’s a simple timeline of the ACA’s 3-Legged Stool:
1/ Here’s how the #ACA’s 3-Legged Stool was *supposed* to work when the law was passed. The blue leg includes the patient protections. The red leg is the part everyone hated but which served an important purpose. The green leg is the financial help for people to pay for it.
2/ This is what it ACTUALLY ended up looking like: There were two main problems. The financial assistance was cut off at 400% FPL income (& wasn’t generous enough), and the mandate penalty wasn’t strong enough to be fully effective. Both were EASILY fixable.
