Come back starting at 10:00am to see whether they decide to tear away healthcare coverage for up to 34 million Americans based on the most absurdly stupid case imaginable!
There's around ~20 cases left for SCOTUS to issue opinions on this term including the #ACA case...which still might be bumped until later this month (I believe the term ends on June 30th).

They wait 10 minutes between each opinion being released, so it could be a long morning...
Once again, there's basically 4 possible ways the SCOTUS could rule on the #ACA case. Two of them would be fine. One would be pretty awful. One would be absolute disaster.

There have been so many false alarms from SCOTUS re. announcing their #TexasFoldEm #ACA lawsuit decision that I’m not even linking to my explainer this time. But...yeah, they’re supposed to announce more opinions tomorrow morning.
There’s apparently 24 more cases to decide on in the next 28 days, so theoretically they could announce like 1-2 per day and still hold off until June 30th for the ACA case.

NOTE: I plan on live-tweeting this morning's SCOTUS announcements (well, technically I'll be parroting @SCOTUSblog's live-tweets) which start at 10am, but I have to leave for an appointment at around 10:30am, so if they end up issuing more than 2-3 opinions I'll have to cut out.
As many people have noted, SCOTUS didn't issue the last 2 major #ACA decisions until the end of June (June 28th for NFIB v. Sebelius, June 25th for King v. Burwell), so there's a *very* good chance they'll wait until then for the #TexasFoldEm case as well...but who knows?

One of the less-appreciated provisions of the #ACA is that it requires ALL compliant healthcare policies to cover a long list of preventative services at NO cost to the patient--no deductible, no co-pay, no coinsurance--as long as they're done in-network.

Believe it or not, there's an important connection between #HR1 and the #TexasFoldEm lawsuit to strike down the #ACA pending a #SCOTUS decision right now. 1/
The #TexasFoldEm case, brought by 20 GOP state AGs, uses insane "logic" to claim the #ACA's individual mandate is unconstitutional because the GOP changed the penalty amount to $0.

However, it ALSO argues that since the mandate is unconstitutional, the ENTIRE LAW is as well. 2/
The first issue is re. merits of the case, which most legal experts from ACROSS the political spectrum agree are either nonexistent or weak at best.

The SECOND issue is re. "severability"...that is, whether you can strike down one part of a law without striking down the rest. 3/

🚨 Here we go again: The decision on the #TexasFoldEm lawsuit deciding the fate of the #ACA *may* (or may not) be on the agenda a week from today.
AS A REMINDER, Congress still has one shot to #MootTheSuit before SCOTUS issues their decision...but at this point it seems like everyone involved is taking it as a given that the law will be upheld after all.

Praying "everyone" is correct. 🙏

Note: This doesn't mean the #TexasFoldEm case is over; all it means is that the DoJ is now formally DEFENDING the #ACA instead of siding with the GOP plaintiffs.

The case was already heard by SCOTUS in November. The decision is expected sometime this spring or summer.
The other option is for Dems to #MootTheSuit via simple legislation to either:

1. ⬆️ the mandate penalty back to $1 or more
2. Formally state that the mandate can be ✂️

There was a chance the Supreme Court would either save *or* kill the #ACA this morning as part of several decisions announced...but the #TexasFoldEm case turned out not to be among those.

That means the ACA will likely survive at least until sometime this spring/summer. 2/
The good news is this means Congress still has time to #MootTheSuit. There's three possible ways to resolve the issue before SCOTUS issues their decision:

1. ⬆️ the penalty to $1 or more
2. Clarify that the mandate can be✂️

HOWEVER, both @ShermanCourt and @AHoweBlogger have noted that the #SCOTUS website indicates that they're scheduled to issue opinions on several cases "argued in the fall and/or winter" tomorrow (Wednesday) morning.

Before 11/08/16, I was secretly planning on shutting down (or at least mothballing) ACASignups.net as soon as the 4th #ACA Open Enrollment period was over. Traffic had been gradually dropping off as people got used to the ACA & it started to fade from the headlines.
My official day job as a website developer had suffered. What was supposed to have been a 6-month hobby in my spare time had turned into a full-time job, and I had lost web clients along the way. I figured it would be time to wind down ACA Signups & refocus on my web business.

The Supreme Court heard oral arguments in the asinine #TexasFoldEm case (brought by ~20 GOP state AGs, including the corrupt @KenPaxtonTX) in November.

They're expected to issue their final ruling sometime this spring or summer, possibly as early as April. 2/

CJ John Roberts now bringing up the fact that the Obama Admin argued that the mandate penalty was "critical" in 2012; why is it no longer "critical"...Verrilli (for the defense) makes exactly my point: The situation was very different in 2012 vs. 2020.

Verrilli correctly notes that the carrot (financial subsidies) simply turned out to be far more important than the stick (mandate penalty).

Put another way: GOP cut off most of the red leg...which was then replaced by the World's Most Expensive Shim®.

In 2010, virtually every insurance carrier said they wouldn't participate in the ACA exchanges without a mandate. If that had happened, the law *would* have failed *at that time*. 2017 wasn't 2010.

Until #RBG’s passing, I felt Dems should wait until after Inauguration Day to do this. Now, I’m more inclined to think they should go for it immediately.
Waiting until January assumes that SCOTUS won’t actually issue a RULING on #TexasFoldEm until next spring. Given how quickly they’re trying to ram thru RBG’s replacement, it’s possible that they’ll issue the ruling during the lame duck period. If that happens it’ll be too late.
