When @EleanorTerrett and I were discussing the @SECGov summary judgment, I didn’t bring up the one thing that stood out the most, b/c I had only read it once, right after reading @Ripple’s brief. I didn’t want to misspeak or be wrong. I’ve now read the @SECGov’s brief a 2nd time.
What, without a doubt, is the most glaring thing missing from the SEC’s motion for summary judgment?

THE SEC DOES NOT RELY ON A SINGLE EXPERT!

There is NO SEC expert testimony attempting to prove price correlation between the efforts of Ripple and the price of #XRP.
There is NO SEC expert testimony claiming #XRPHolders relied on the expertise, skill or management of the Ripple team OR expert testimony claiming #XRPHolders were led by promises and inducements made by Ripple, before acquiring #XRP.

A FEW OBSERVATIONS:

1) I was wrong before when I said there were 52 Drafts of the Hinman Speech.
The judge writes: “as evidenced by the 68 Drafts and associated commentary in the SEC’s privilege logs.”

68 drafts w/ lots of commentary. There’s a strong chance #XRP is mentioned!
2) Judge Netburn added a bullet proof section for any appeal to the 2nd Circuit. She could’ve flat out denied the motion for reconsideration pursuant to Rule 6.3 (can’t raise new arguments you didn’t the first time). Instead, she recognized how important the DPP Doctrine is. 👇
She didn’t just summarily deny the motion but analyzed the SEC’s substantive DPP argument and then rejected it. I ❤️ IT!What she did was take away any argument on appeal based on how important DPP is and that this judge didn’t consider it like she should!!

This is significant evidence in @SECGov 🆚 @Ripple & and even more significant evidence in #XRPHolders 🆚 @SECGov.

Some additional thoughts:
Amy Starr is likely one of the fact witnesses from the #SEC that #Ripple elected to depose in addition to William Hinman.

Her name was brought up in the Hinman deposition. See pic 👇

In the Consensus 2019 video Amy states “we have people that really understand the technology.”
Amy Starr states that at the #SEC “we developed an expertise” in blockchain technology and that at the #SEC “we participate internationally.”

Why is this all significant? One, #XRP was internationally recognized as a non-security!

Two, the #SEC was an expert and understood

One reason of many why the Hinman Deposition is a BIG DEAL:

Excerpt of Hinman Speech:

“And putting aside the fundraising that accompanied the creation of Ether, based on my understanding of the present state of Ether, the Ethereum network and its decentralized structure,
current offers and sales of Ether are not securities transactions.”

Hinman met with a founder of #Ethereum 1 week before the speech and again afterwards.

1) Putting aside the fundraising is a BIG ASIDE;

2) What did the founder say that helped form his “understanding”;
3) @Ripple’s lawyers will have him walk through his “understanding” of decentralization;

4) have him admit he communicated his understanding to market participants which created the standard within the market;

5) show that #XRP’s decentralization meets that understanding; and
