#AllahabadHighCourt directs the UP Government (@UPGovt) to prepare a revised list of Assistant Teachers rectifying the irregularities in fixing quota for their appointment.

The #AllahabadHighCourt also quashed the select list of additional 6,800 teachers issued by the State Government to appoint additional candidates as primary assistant teachers in the state in addition to the already appointed 69,000 candidates.

The #AllahabadHighCourt observed that the rules were not followed in fixing reservations in the recruitment process. In such a situation, the Court directed the state government to review the select list released on January 1, 2020.

Law books publisher @LexisNexisIndia to contribute a sum of Rs. 1 Lakh each to the #AllahabadHighCourt Bar Association and the High Court Advocates' Association. It will also supply one set of all the Bare Acts published by it to both the Associations.

During hearing of a case, wrong publication of a Bare Act by the publisher came to light. Taking serious note, the High Court issued notice to the publisher to show cause as to why appropriate action be not taken against it for misleading the Court and members of the Bar.

In its affidavit, publisher stated that the error was not intentional and t will be more careful in future. It also told that an exercise has been started for updating Bare Acts.
However, as a 'good gesture', the publisher proposed to contribute the sum to the Bar Associations.

Noting that a hypertechnical and mechanical approach shall do no good to the parties, #AllahabadHighCourt grants bail to a rape accused.
The barely major young man had allegedly enticed away his alleged minor lover and got her pregnant. The girl child is 3.5 years old now.

Court took note of the youth's submission that he and the victim were lovers and due to fear of families and co-villagers who were against their alliance as the two belonged to the same village and community, they eloped and the girl's father filed a case against him.

Court said, "In this conservative and non-permissive society, it is true that marriage in the same village is prohibited and is not customary, and it may be an after effect of media and cinema, instances of marriage in the same village are on the rise."

#AllahabadHighCourt holds that against any order u/S 5 of the Maintenance and Welfare of Parents and Senior Citizens Act 2007, the right to appeal u/S 16(1) is available 'not only' to the senior citizen and parents 'but also' to the children, relative, or other person too.

Section 16(1) reads, "Any senior citizen or a parent, as the case may be, aggrieved by an order of a Tribunal may, within sixty days from the date of the order, prefer an appeal to the Appellate Tribunal....."

Court said, "Maintenance has to be given by some person or institute or a juristic person and if such a maintenance is been granted, some person must be affected and thus, non-mentioning of the words in Section 16(1) is not a casus omissus, but it seems an accidental omission."

Today #AllahabadHighCourt refused to quash criminal proceedings against one Niyaz Ahmad Khan booked for sharing PM Narendra Modi and Home Minister Amit Shah's morphed images on Facebook.

In 2018, Khan had shared one morphed photo of PM shaking hands with #terrorist Hafiz Saeed.

In another morphed photo shared by Khan, #PrimeMinister and #HomeMinister were shown feeding biscuits to dogs, on whom "Aaj Tak TV", "Zee TV" and "India TV" was written.

Taking note of Khan's act, Court observed,
"Use of Cyberspace by some people to vent out their anger and frustration by travestying the Prime Minister, Key-figures holding the highest office in the country...is abhorrent."

Just In: PIL moved before #AllahabadHighCourt seeking stay on streaming of the short film 'Why I killed Gandhi'.

It's been alleged that it may disturb the peace and social harmony in Uttar Pradesh amid ongoing Assembly elections.

The petitioners have alleged that the movie which has been released on the OTT platform 'Limelight' has highly objectionable dialogues.
It's been also said that the content of the movie tarnishes #Gandhiji's image.

It is significant to note that against the release of this movie, a writ petition was filed before the Supreme Court which the top court refused to entertain. However, liberty was granted to the petitioners to approach the concerned high court.

[Loudspeaker ban] Gujarat High Court issues notice on a PIL plea seeking a statewide ban on loudspeakers in mosques.

On a plea moved by a doctor who runs his clinic in state's Gandhinagar district, Chief Justice Aravind Kumar led bench issued notice to the Gujarat government.
The doctor had alleged that people who live nearby any mosque are made subject to great inconvenience and disturbance.

The doctor had demanded the practice to be prohibited stating that despite the fact that due to covid protocols, many of the namaz offerees are not reaching mosques for the prayers, the mosques are using loudspeakers during prayers.

#AllahabadHighCourt directs the Principal Secretary, Basic Education, Government of Uttar Pradesh to 'ensure' that all the District Basic Education Officers start performing their duties 'promptly'.
Court had noted that department's officers are taking their jobs very casually.

Court said, "This is sorry state of affairs .....This Court is flooded with writ petitions every day simply for a direction upon these officers to decide the grievances."

Therefore, court directed that it is to be ensured that all the matters which come before such officers for consideration, get disposed of 'at the earliest'.

#AllahabadHighCourt declines to handover the custody of minor girl child from her father to her mother in a habeas corpus writ petition.

Court said that in such matters, writ of habeas corpus will be entertainable only if the child has been detained illegally/without authority.

The couple had already filed for divorce. Taking this fact into account, court said that in such matters, the remedy would lie under the Hindu Minority and Guardianship Act, 1956 or Guardians, and Wards Act, 1890 GWA, as the case may be and, accordingly, rejected woman's plea.

Marriage between child's parents had taken place in 2014 and she was born in 2016.
In 2020, following matrimonial disputes, her mother was allegedly kicked out of the house and since then she was seeking her child's custody.
