Now that we have the text of the #DMA published, let me point out a couple of outstanding provisions that have data protection implications & that show why this Regulation concerns all businesses & platform users, not only gatekeepers. Let's go 🧵 1/?…
First of all, check out the list of Core Platform Services that may pull a business into the gatekeeper class (Art 2). Notably including web browsers, virtual assistants, & *online advertising services*, e.g. Exchanges, as long as they are provided by a business offering a CPS 2/
But this is not a thread about the threshold to become a gatekeeper (check Art 3). It just points out data protection implications of the #DMA. Of note, "consent", "profiling" in the #DMA are defined as in the #GDPR. Bonus: "non-personal" data & "data" are also defined 3/

Elsewhere in EU regulatory pipe-dreams authored by people who apparently have more good intention than understanding, the #DMA means that @WhatsApp and @signalapp should both adopt #XMPP and thereby deliver a unified "inbox" of messages.

When I first encountered the idea of disappearing messages, I thought they were stupid, but I was wrong. I thought that the point of disappearing messages was to let you send secrets to someone you didn't trust, because the message would disappear and thus be safe. 2/
Obviously, this is stupid. If you send a secret to someone you don't trust, that untrustworthy person can take a screenshot, or use another device to photograph their screen. Or, you know, they can just *remember* the secret and blab it. 3/

What's the big data privacy/security problem with EU techlash legislative proposals (#DSA, #DMA)?
🧵 A quick big picture explainer...
First, a general lesson on legal regulation. Law is not magic. Just because a law seems to require something (e.g. because it expressly says it does), it doesn't mean
(1) this thing will actually happen and
(2) the law actually requires it.
Just because a law says: "do this risky thing in a secure way", it doesn't mean that this law *really* allows doing that risky thing in a secure way. Wait, what?

Splošni pristop glede zakonodajnega predloga Akta o digitalnih storitvah (#DSA), ki so ga minuli teden sprejeli ministri za gospodarstvo na zasedanju Sveta za konkurenčnost (@EUCouncil | #COMPET), odraža neambicioznost članic EU pri zaščiti pravic evropskih državljanov na spletu.
Oba zakonodajna dokumenta, poleg #DSA še Akt o digitalnih trgih (#DMA), sta pomembna za enotni digitalni trg. Čeprav splošni pristop, ki ga je sprejel @EUCouncil, predstavlja določen napredek, pa še zdaleč ne zagotavlja ustrezne ravni varstva evropskih državljanov in potrošnikov.
Pripravo splošnega pristopa zaključuje tudi Odbor Evropskega parlamenta za notranji trg in varstvo potrošnikov (@EP_SingleMarket | #IMCO). S tem bo tlakovana pot, da Svet EU (@EUCouncil) in Evropski parlament (@Europarl_EN) prihodnje leto pripravita končno besedilo #DSA.

Some approved experts would be allowed under certain condition, access to some inside data from the platforms.What can go wrong ? Let’s ask the annoying quetion : what kind of access, what is "data" and how do we plan to organise the "vetting"
"access" does not means a "right to publish". Data, used, stored, accessed or published are governed by General Data Protection Regulation. #GDPR is highly protective of users, but, platforms like to use GDPR to shut down researchers accessing their data (like @algorithmwatch)

I've slept on it. Here's a 'tepid-take' (HT @DrMJCole) on Google ruling.
- politically: huge for @vestager
- practically: won't change much becoz #DMA is new kid in town,
- legally: EU judges' stance on 'essential facility' will cause controversy & perhaps an appeal
1st, politically:

Court approval for @EU_Competition mantra of 'self-preferencing' is huge; this concept underpins the last decade of action & rhetoric from Brussels, and now the whole world.

Court blessing for that will be read as: 'keep going, you're on the right track.' /2
Losing this case would have been a horror for the entire policy drive, for cases against @Apple @amazon @Meta & for @vestager reputation. As it is, EC goes into all that strengthened.

Court also said Google's "abnormal" conduct can't be explained away as the right to innovate/3

#DMA getting more complex by the minute. Today, national #antitrust watchdogs weighed in with a joint paper, saying they want to enforce it as well.

This is turning into a bit of a mess. Some thoughts. First, here's the paper:… /1
First half of the paper is a big brag about all the Big Tech work the authorities have done. Hard to contest this. Watchdogs in FR & DE have, in particular, been doing plenty in recent years. For them, this means they have loads of knowledge. And the DMA should make use of that/2
While @EU_Competition should be in the lead, the NCAs want powers to enforce as well. So, for example, this would mean @Kartellamt could suspect a tech abuse & deploy: EU Art 102, national dominance rules (two of them), GWB19a & then also the DMA. That's a lot. /3

What we are trying to do is create a system wch will ensure cyber defence. We have been able to create a cyber agency within armed forces & each service has also own cyber agency, so that even if we come under a cyber attack the downtime of the attack doesn’t last long: Gen Rawat
We should be able to overcome that cyber attack and continue with our systems either through alternate means or preventive means through firewalls: Gen Rawat
