Amazon is a perfect #enshittification parable - platforms subsidize end users until they're locked in, then make life good for business customers at users' expense, until *they're* locked in, then claw back all the value they can, leaving just enough to keep the lock-in going.

Big Tech steals from the news, but what it steals is *money*, not *content*. Talking about the news, excerpting it, linking to it, quoting it - these are all beneficial, normal news activities. If you can't talk about the news, it's not news - it's a *secret*.

But tech *does* steal from news. A variety of monopolistic tricks allows tech to interpose itself between reporters, publishers and outlets, and the audiences they serve. By creating chokepoints between the news and its audience, tech can extract gigantic sums from the news.

It’s been a long year of continued challenges and threats to our information ecosystem.

We’re so proud of our work to hold Big Tech accountable and advocate for meaningful structural reforms to protect and advance democracy. Here are some highlights of our progress in 2022: 🧵
We joined partners and youth organizations to help pass the #CAKidsCode in California to require online platforms to prioritize young people’s safety by design and default. The bipartisan law offers a roadmap for more states to protect young users. nytimes.com/2022/09/15/bus…
We elevated youth activists and organizations like @logoffmovement by sharing the lived experiences of young people navigating Big Tech’s harms. We hosted a youth roundtable with @SenBlumenthal and partnered with young diverse digital creators to spread our campaigns online.

This is a huge deal. While Apple's "curated" approach to software delivers benefits to users, those benefits are unreliable. As I explain in a new post for @EFF's Deeplinks blog, Apple only fights for its users when doing so is good for its shareholders. 3/

Mobile tech is a duopoly run by two companies - Google and Apple - with a combined $3.5T market cap. In some ways, this is unsurprising. Since the #GDPR's beginning, it's been crystal clear that the intention of the landmark privacy regulation was to extinguish commercial surveillance and ring down the curtain on #ConsentTheater. 3/

Der #DigitalMarketsAct ist eine beispiellose Gesetzgebung für Verbraucherschutz & Einhaltung von (Straf-)Gesetzen. Hier das Beste aus 81 (!) Seiten. #DMA #Breton #Zensur (?)🧵 1/
Also los, was bringt der #DMA wirklich?
1. DMA trifft nur „Gatekeeper“, also z.B. 2/

. @EuropeanCommiss #DMA prohibits Big Tech platforms to give advantages to their own services. So, too, does my fav part of #C18, the Online News Act (s51). This is way better than the weak beer found in #C11, the Online Streaming Act. #CRTC

Inevitably the response is something glib like "Use Matrix"
A big part of the the reason for the existence of that API was because the European Union wanted to enable people to access their data; so they created the problem, complained when the inevitable leaks happened, and are now reinventing it

Now that we have the text of the #DMA published, let me point out a couple of outstanding provisions that have data protection implications & that show why this Regulation concerns all businesses & platform users, not only gatekeepers. Let's go 🧵 1/?
consilium.europa.eu/media/56086/st…
First of all, check out the list of Core Platform Services that may pull a business into the gatekeeper class (Art 2). Notably including web browsers, virtual assistants, & *online advertising services*, e.g. Exchanges, as long as they are provided by a business offering a CPS 2/
But this is not a thread about the threshold to become a gatekeeper (check Art 3). It just points out data protection implications of the #DMA. Of note, "consent", "profiling" in the #DMA are defined as in the #GDPR. Bonus: "non-personal" data & "data" are also defined 3/

Elsewhere in EU regulatory pipe-dreams authored by people who apparently have more good intention than understanding, the #DMA means that @WhatsApp and @signalapp should both adopt #XMPP and thereby deliver a unified "inbox" of messages.
@WhatsApp @signalapp Not making this up: ImageImage
> With a constant onslaught of messages pinging our phones and computers, who wouldn’t want that?

Well, for one, "people who use different applications to deliver different functionality and security profiles"

WhatsApp: family
Messenger: neighbours
Signal: infosec nerds

This week on my podcast, I read my @Medium column, "When Automation Becomes Enforcement," on the debate of interoperability and end-to-end encryption in the Digital Markets Act, and the long-running battle over who's in charge: you, or your computer?

When I first encountered the idea of disappearing messages, I thought they were stupid, but I was wrong. I thought that the point of disappearing messages was to let you send secrets to someone you didn't trust, because the message would disappear and thus be safe. 2/
Obviously, this is stupid. If you send a secret to someone you don't trust, that untrustworthy person can take a screenshot, or use another device to photograph their screen. Or, you know, they can just *remember* the secret and blab it. 3/

Aside from public narrative (universally adverse), a ton of economic research underway looking at the behavior of hybrid marketplaces, esp. Amazon. What does it show? Does anyone care? Should regulators/enforcers care & acknowledge the tradeoffs? Or is it all beside the point? 3/

What's the big data privacy/security problem with EU techlash legislative proposals (#DSA, #DMA)?
🧵 A quick big picture explainer...
First, a general lesson on legal regulation. Law is not magic. Just because a law seems to require something (e.g. because it expressly says it does), it doesn't mean
(1) this thing will actually happen and
(2) the law actually requires it.
Just because a law says: "do this risky thing in a secure way", it doesn't mean that this law *really* allows doing that risky thing in a secure way. Wait, what?

#LSR Image
