Today, August 29, 2020, marks my family’s 20th year in the United States.

I remember arriving with my parents and two younger brothers to Miami, FL like it was yesterday. Day 1 was a lunch at Burger King and a visit to Toys R Us while my dad got his SSN card.
We didn’t know it then — but the challenge of “making it in America” would run past 20yrs.

Two full decades filled with the challenges of settling into a new country, only to then later fear being sent back we fled amid political/economic/social unrest.
In 2005, after my parents were told to stop renewing their visa, a lawyer (now disbarred) told them to apply for a Green Card.

Months went by, my parents filed the application and paid the money, only to later discover the lawyer he shuttered her office and mishandled the case.

Between August 2009 and January 2010, during @BarackObama's first year as President of the United States, Democrats held a 60-40 advantage in the U.S. Senate (when counting two independents, they being Bernie Sanders and--buerk—Joe Lieberman). Did they do it then? Nope.
Did they pass the #DREAMAct? Nope. Six Senate Dems killed it.

Did they pass any federal minimum wage increases? Nope. The last one was signed into law (by George W. Bush) in 2007.

Did they pass health care reform with a public option? Nope. They let Lieberman kill it pre-vote.
Did they restore some form of Glass-Steagall after the Great Recession? Nope. It's still being proposed over a decade later.

Did they permanently codify reproductive + voting rights and eliminate the Pink Tax? Nope.

Did they codify substantive campaign finance reform? Nope.

BREAKING / thread: Trump & DHS are now in open defiance of the Supreme Court and several federal courts. Despite being ordered to restore the entire #DACA program (including new applications) they now openly announce that they will not do so: dhs.gov/sites/default/…
2/#SCOTUS gave Trump a clear roadmap. Everyone agrees he can end #DACA / modify, but he needs to go through a legal process that SCOTUS outlined. He refuses. Instead he issues a memo saying he's "considering" what to do about DACA and in the meantime defying the federal courts.
3/ This is blatantly unlawful, from the same @DHSgov whose goons are in the streets beating and arresting peaceful protesters in the name of "law and order."

1/ By amending no more than THREE WORDS of the Immigration & Nationality Act, Congress could amend a 91-yr-old law to grant a pathway to citizenship to millions of undocumented Americans in a piece of legislation shorter than this tweet.

Really: three words!

Here's how:
2/ Loosely speaking, the U.S. had virtually open borders for everyone other than Chinese/East Asians until 1917.

The visa system was then formalized in 1924 based on white supremacist "national origins quotas" explicitly designed to favor white northern/western Europeans.
3/ As strange as this is to think of today, we simply weren't keeping good track of who was coming to the country at a federal level until 1906 and there was no mandatory requirement that new immigrants register with the government once here.

There wouldn't be until 1940.

THREAD: Lots of negative media speculation about #DACA after today's oral arguments at #SCOTUS but here are key things to keep in mind:
1/ There is NO #DACA decision today. We likely won't have a decision until spring, or as late as June. Until #SCOTUS decides, the program remains in effect.
2/ Oral argument at #SCOTUS is NOT necessarily a preview of individual justices' views or the final decision. Justices often play "devil's advocate." We should not be assuming that they will kill #DACA just because they made skeptical comments or asked tough questions.

First, YES to more questions about President Obama’s catastrophic failure on immigration. There should be more discussion about his deportation policy, legislative approach, & political strategy. If we don’t get this empirical diagnosis right, we are doomed to repeat failure. /2
On this, if Biden is just gonna demur by claiming dude-bro level fealty to his former boss, then he needs to be asked what, if any, will be the proper role for his VP in developing and implementing immigration, refugee, and border policy. /3

Today is the 7th Anniversary of the Implementation of #DACA — here is HOW I got to August 15, 2015, to see my life COMPLETELY transformed overnight.

The story begins in 2007, I was a high school senior ready to graduate and ready to go @UCF!

Here's an awk photo of me.
SPRING 2007: I receive a call from an @UCF admissions officer. They told me that my application was missing a Green Card, and that they would be unable to give me in-state tuition w/ot it.

Confused, I asked my mom for a copy of the document — not knowing I didn't have one.
My mother froze and drove me to @FIU to ask if I would go to college. An admissions officer told her that w/o a Green Card, my family wouldve to pay 3X the amount of in-state tuition.

My mother was CRUSHED. I lied and said everything would be OK. It wouldnt be.

The Trump Executive Order to stop separating kids from their parents is classic lipstick on a pig. Their border policy is still an immoral and un-American pig.
There is apparently no plan, nor ability, to reunite parents and kids that are now separated. Some parents have been deported without their children and it may be impossible to identify other children who are being held. The damage already done is deep and long lasting.
The Executive Order will permit indefinite detention of families with their children in internment camps, even though that’s illegal under existing law. The Flores case prohibits indefinite detention of minors, accompanied or not.

On this day 6 years ago President Obama established #DACA. This program gave young immigrants the chance to come out of the shadows and be part of the only country they’ve ever called home.
In September of last year, President Trump made the cruel decision to end #DACA. Now, 800,000 Dreamers face deportation to countries they have never known.
I’ve been urging Republican leaders in Congress to do the right thing by these kids and pass the bipartisan #DreamAct. It’s the only way to protect these talented students, teachers, nurses, and a whole host of others who love this country as much as anyone.

35 year old Dreamer, #DACA expiring Mar 2018. Came to US with parents at age 4. No criminal record. Never left US.
Goes to see an immigration lawyer his family's been working with for years.

Privileged, because most cannot afford counsel. Though they're "lawbreakers," the government doesn't provide them lawyers.

Let's figure out how to help our Dreamer!
"Leave and come back legally."

Leaving will trigger a 10 year bar to reentry. A waiver (forgiveness) exists, but our Dreamer doesn't qualify. He has no kids or spouse who are US citizens or green card holders. An uncle is, but that doesn't help.

A thread on Trump's new buzzword, #ChainMigration.

You'll hear it constantly now. Some horrendous threat that must end in order to move on the #DreamAct. (Plus a wall.)

But how new is it? And what does it actually mean? @Allandaros and I investigated.
First, the term chain migration exists nowhere in the immigration law. Not in the Immig & Nationality Act, the CFR, field manuals, memos, or FAQ's.

The term for individuals sponsoring their family members is called (surprisingly): family-based immigration.
Our immigration laws only allow spouses, parents, children, and siblings to be petitioned. You must be a permanent resident or US citizen in order to do it. Sometimes the wait is 1 year or so. Other times, decades.

There's no direct way to sponsor an uncle, grandparent, etc.
